The government has adopted a draft act on another additional annual cash benefit for pensioners, said Prime Minister Mateusz Morawiecki. It is about a bill introducing the payment of the so-called 14th pension on a permanent basis.

– From today the Council of Ministers adopted the fourteenth as a permanent benefit for all pensioners in Poland – informed the Prime Minister Mateusz Morawiecki on Tuesday.

The rules will apply to pensions and pensions in the general system, farmers, uniformed services, bridging pensionspre-retirement benefits and allowances, social pensions, teacher compensatory benefits, supplementary parental benefits, a cash benefit for blind civilian victims of warfare and pensions for war and military invalids.

According to the draft, the 14th old-age pension will be due to the entitled persons in the amount of: the amount of the lowest old-age pension applicable from 1 March of the year in which the next additional annual cash benefit is paid – for persons whose basic benefit before deductions, deductions and reductions does not exceed the amount of PLN 2,900; the amount of the lowest old-age pension, applicable from 1 March of the year in which the next additional annual cash benefit is paid, reduced by the amount of the difference between the amount of the basic benefit before deductions, deductions and reductions and the amount of PLN 2,900, the amount of which is the basic benefit before deductions , deductions and reductions, exceeds PLN 2,900.

The draft provides for the possibility of determining a higher amount of the 14th old-age pension. The Council of Ministers, no later than by 31 October of a given year, by means of an ordinance, will be able to specify a higher amount of the next additional annual cash benefit than the amount of the lowest old-age pension.

The bill proposes that the amount of the 14th old-age pension should be at least PLN 50. If the amount of the next additional annual cash benefit is lower than PLN 50, this benefit will not be granted.

“Fourteen” will not be available to persons whose right to benefits has been suspended on the last day of the month preceding the month of payment of the next additional annual cash benefit. This means that persons whose right to the basic benefit has not been suspended on the last day of the month preceding the month of payment of the next additional annual cash benefit will be entitled to the next additional annual cash benefit, and the amount of this benefit does not exceed the sum of PLN 2,900 and the lowest old-age pension applicable in the year in which the next additional annual cash benefit is paid, reduced by PLN 50 (in 2023 it is PLN 4,438.44).

In the event of the concurrence of the right to more than one benefit, the sum of these benefits paid in concurrence will be adopted when determining the right and the amount of the next additional annual cash benefit. The entitled person will be entitled to one further additional annual cash benefit.

One additional annual cash benefit will also be payable to a survivor’s pension to which more than one person is entitled. This benefit will be proportionately divided among persons entitled to a survivor’s pension. If more than one person is entitled to a survivor’s pension and at least one of them is entitled to a social pension, the next additional annual cash benefit under the survivor’s pension will be divided according to the number of persons entitled to a survivor’s pension, excluding the person or persons entitled to a social pension. A person or persons excluded from the number of persons entitled to a survivor’s pension will be entitled to another additional annual cash benefit under the right to a social pension.

It was proposed that the next additional annual cash benefit should be awarded ex officio on the basis of a decision. The Council of Ministers is to specify, by regulation, no later than 31 October, the month of payment of the next additional annual cash benefit in a given year.

Decisions on the 14th pension will be issued and paid by the competent pension authorities. In the event of the concurrence of the right to benefits that are paid by two bodies, decisions are issued and another additional annual cash benefit is paid Social Security.

The draft also regulates the issue of the eligibility and payment of the next additional annual cash benefit in the event of the concurrence of the right to pension benefits paid by different pension bodies, after the date of issuing the decision on granting the next additional annual cash benefit by the pension body.

The amount of the next additional annual cash benefit will not affect the rights of persons applying for benefits, allowances, allowances, assistance or support (e.g. rehabilitation relief). There will be no deductions or collections from the amount of the next additional annual cash benefit.

The next additional annual cash benefit will be paid in the amount reduced by personal income tax and health insurance premium. The next additional annual cash benefit and the additional annual cash benefit will be financed from the state budget, while maintaining the transitional solution for 2023, in which the financing of additional benefits related to the payment of the 13th and 14th pension from the Solidarity Fund is maintained.
