The Minister of Justice, Prosecutor General Zbigniew Ziobro reacted. By virtue of his decision, Marika left prison. The law allows for a break in punishment during the course of the pardon proceedings.

According to Ziobro, the woman was convicted for “political reasons”. “This is an extremely disturbing situation. For political and ideological reasons, the court deprived a young girl, a young woman of her freedom, and sentenced her to three years of hard prison. These are things that cannot be imagined,” he said at a press conference. – There was a robbery in this case, but a judicial robbery on Marika – he added.

The case was commented on by the guests of “Fakty po Faktach” – prosecutor Ewa Wrzosek and judge Bartłomiej Przymusiński from the Association of Polish Judges “Iustitia”.

According to prosecutor Wrzosek, contrary to Ziobro’s statements, “we are not dealing here with a judicial robbery or a judicial crime.”

– These are terms that Ziobro uses in a purely instrumental, cynical and populist way to direct hate towards the judges who issued this verdict, towards the prosecutors who filed the indictment in this case – she assessed.

– This situation cannot be underestimated. We know that there are threats against the judge, this situation requires ensuring the safety of an officer who performed his duties and issued a sentence on the basis and within the limits of the law – said Bartłomiej Przymusiński.

The TVN24 guest pointed out that “in this case, the judge issued a sentence within the limits of the lower penalty”. – On the other hand, the fact that this lower penalty was three years of imprisonment is the effect of, among other things, penal populism, one of the authors of which was Zbigniew Ziobro, because it was the 2006 law that increased the thresholds – he noted. As he explained, political populism “is not only increasing penalties, but also tying the hands of judges so that they cannot impose milder penalties than politicians have invented in the act.”

– The Code did not allow the judge to apply a more lenient punishment – said Przymusiński. The verdict could not have been different. The circumstances of the act established during the trial meant that it had to be considered a robbery of a hooligan nature and it could not be otherwise – argued the judge.

As he added, “it was not a sentence for yanking a bag, it was a sentence for trying to steal a bag with violence.” “The victim’s body was also damaged,” he said.

– We have lost sight of the most important person in this case – the victim – said prosecutor Wrzosek. She emphasized that “the victim was not a handbag for PLN 15, as it is tried to be presented”. This is an attempt at a very serious crime. We have a victim, a random girl who was called, attacked, pulled, who perhaps, if she had not been with her friend at the time, would have been the victim of an even worse crime – added Wrzosek.

As she said, “the prosecutor’s office is to prosecute the perpetrators of crimes, and all the activities of the prosecutor general are aimed at ensuring impunity for the perpetrators of the crime.”

This is not an ideological dispute. This is a hate crime, the prosecutor said.

– It’s not a sentence for opinions. It is a sentence for a specific act, a specific behavior that has the characteristics of a crime – judge Przymusiński echoed her. As he added, “what the perpetrators were doing was attacking for their views.”
