A new obligation for employers. The Senate gave the green light

On Wednesday, the Senate adopted an amendment to the Labor Code on wage openness, but with amendment. The employer will be obliged to provide the candidate for a position in advance of the information about the proposed remuneration to enable him to consciously and transparent negotiations.

56 senators voted for the amendment along with the adopted amendments, against 2, and 29 abstained. The act and amendment will now return to the Sejm.

According to the proposed provisions, information on remuneration, its initial amount or its compartment – based on objective, neutral criteria, in particular in terms of sex will be received by the person applying for employment in a given position.

Remuneration open. What does it look like in practice?

Information about the pay will be presented to the candidate for the position:

– in the recruitment advertisement; – before the interview, if the employer did not announce recruitment for the position or did not provide this information in the announcement; – Before establishing an employment relationship, if the employer did not announce recruitment for the position or did not provide this information in the advertisement or before the interview.

The amendment adopted by the Senate concerns the wording according to which the employer will be obliged to provide the above information in paper or electronic form – in advance, enabling the candidate to read them. The purpose of such a solution is to enable the person applying for employment of conscious and transparent negotiations.

What else will change?

In addition, the employer will not be able to demand from the candidate for the position of submitting information on remuneration in the current employment relationship and in previous employment relations.

The regulations also oblige the employer to make a free position and position names to be neutral in gender, and the recruitment process was in a non -discriminatory manner.

While working on the project of the Minister of Work, Agnieszka Dziemianowicz -BÄ…k pointed out that the pay gap in Poland is – depending on the research and years – from a few to several percent to the detriment of women. “According to Eurostat, in 2023, the average was 12.7 percent throughout the European Union.” – the minister pointed out.
