– I only know which wife died. Her watch, returned to me by the police, stopped at that hour – said the deceased’s husband on Wednesday. The event has not been seen. Accused of contributing to this tragedy, 31-year-old Michał W. appeared in court only five years after the accident. Earlier, the prosecutor’s office only considered him a witness.
It was the afternoon of Wednesday, August 3, 2016. The road was dry, the sun was shining. Andrzej J., now 65, was driving an old silver Toyota. He drove along Fieldorfa Street in the Gocław district of Warsaw from Wał Miedzeszyński towards Ostrobramska Street.
At the intersection with Meissnera he wanted to turn left. In the opposite direction, also along Fieldorfa Street, a white Ford focus – “sporty, about 300 horsepower” – was walking 31-year-old Michał W., a sports instructor.
Several people were standing by the crossing, some were walking along the sidewalk, and some were standing at the stop. Cars collided at an intersection.
The Ford fell off the road onto the sidewalk near the stop. He hit the bicycle that the father and his son a little more than one year old went for a ride, then the cyclist standing behind them and the pedestrian, who went on the bus with his wife and son. On that particular day, their car was still in the garage. The cyclist died on the spot, the pedestrian was seriously injured, he has not regained his fitness to this day, and the boy also suffered.
Father of Leon, who was 14 months old at the time: – We were turned around a post. The son was still in the seat, his helmet was smashed.
A man who was walking with his family on the sidewalk: – First there was darkness and then the sky.
The husband of the deceased cyclist did not see the accident: – I only know about which wife died. At this hour, her watch, which the police returned to me, stopped.
Witness to the accused
Initially, the prosecution decided that the accident was caused only by the Toyota driver, because he did not give way to the Ford driver driving straight ahead. The latter was driving around 80 km / h, i.e. he exceeded the speed limit by at least half. But the prosecution found that this had no effect on the accident. The man, therefore, not only did not hear the charges, but did not even get a speeding ticket.
Thus, at the beginning of 2018, only the then 62-year-old Andrzej J. sat in the dock, but the witnesses of the accident during the first hearing emphasized that they remembered the fast driving of the Ford driver and that he “could race with a motorcycle”.
