On Monday, the Minister of Justice initiated the procedure for dismissing the president and vice-presidents of the Court of Appeal in Poznań: Mateusz Bartoszek, Przemysław Radzik and Sylwia Dembska – the ministry announced. In reference to Radzik, it was written that his actions constituted an “abuse of power.” It was added that the judges were suspended from their duties.

Ministry of Justice reported that on Monday, the Minister of Justice submitted a request to the board of the Court of Appeal in Poznań to express an opinion on the dismissal of the president of this court, judge SA Mateusz Bartoszek, and judges Przemysław Radzik and Sylwia Dembska – vice-presidents of the SA in Poznań.

It was added that the head of the ministry suspended each of the mentioned judges “in their duties.”

“In relation to Judge Mateusz Bartoszek, the minister’s request was justified by a number of omissions and inappropriate actions he committed while performing the function of president, which led, among others, to the deterioration of the statistical results of the court he headed and the disorganization of its work through inaccurate and unjustified personnel decisions , which together constitute a picture of gross and persistent failure to fulfill official duties,” the statement said.

Ministry: Radzik’s performance of his duties cannot be reconciled with the good of the justice system

It was added that in the case of Judge Sylwia Dembska, the minister’s request was justified by “a number of omissions in taking actions aimed at improving the situation of the civil and intellectual property, labor and social security departments supervised by her, which together constitute a picture of gross failure to fulfill official duties.”

“With respect to SA judge Przemysław Radzik, Bodnar’s request was justified by the fact that his performance as vice-president of the Court of Appeal in Poznań cannot be reconciled with the good of the justice system,” the release said. This is about Judge Radzik combining the functions of the deputy Disciplinary Spokesman for Judges of Common Courts and the vice-president of the Court of Appeal in Poznań in the context of Radzik’s previous activities as part of his functions. “In the opinion of the Minister of Justice, a number of these actions constituted an abuse of power,” it was emphasized.
