Bodnar: Women’s rights are being violated in Poland

On the night of May 23-24, 33-year-old Dorota died in a hospital in Nowy Targ. The woman was there in the fifth month of pregnancy after the waters had broken. She died three days later from septic shock.

“Gazeta Wyborcza” reported that throughout Dorota’s stay in the hospital, no one from the staff informed her or her family that the chances of maintaining the pregnancy were minimal. – No one gave us a choice or a chance to save Dorota, because no one told us that her life was in danger. No one mentioned that you can induce a miscarriage and save Dorota, because the chances of the child surviving are slim – said Mr. Marcin, the husband of the deceased, quoted by “Wyborcza”.

– I believe that all these tragedies show how women’s rights are violated in Poland. How women are subjected to inhuman and degrading treatment, if not torture, commented the professor Adam Bodnar. – This is what this judgment of the Constitutional Court of 2020 (limiting the right to abortion – ed.) led to – he added.

Were Ombudsman pointed out that in the public discourse on the right to abortion there is too little presence of doctors who are afraid of possible liability.

– They accept that this fear of the prosecutor overwhelms them and violates the de facto rights of patients – he said. – That’s why doctors take an oath to do everything in their medical knowledge to help patients not be driven by fear. Unfortunately, our country has been operating in such a way recently that making any decision in this sensitive area of life, especially when it comes to pregnancy, is conditioned by fear. Not so much in front of the prison as the prosecutor and the campaign – he added.

However, Professor Adam Bodnar stated that “the state apparatus and social organizations that are friendly to the state, media that are friendly and dependent on the government, have various mechanisms to deprive such a person of public rights in a sense, to present them as an enemy of the nation, an enemy of society, and doctors they are afraid.” – At the same time, we should expect that this fear should not be paralyzing, because it ends up with more deaths of Polish citizens – he added.

The guest of “Fakty po Faktach” also drew attention to the role of politicians. – Politicians should not hide behind some of their ideological conditioning, but should lead to the annulment of the judgment of the Constitutional Tribunal (concerning abortion law – ed.). A normal approach to abortion procedures should return. The prosecutor’s office should not behave politically, he said.

The former Ombudsman stated that in situations where the mother’s life is in danger, “the mother’s life should be the most important value”.
