The Supreme Court referred to reconsideration by the Appeal Court of the death of the death of 21-year-old Adam Czerniejewski shot from a police weapon. Although – as he recognized – the cassation did not defend itself in substance, the judgment must be set aside, because the adjudicating composition of the Łódź court was the neo -Sędzi.

– This decision is the case that waiting for the final decision will be extended by the next months – tells us the attorney of the Father shot, lawyer Zbigniew Krüger, who cited us the content of the Supreme Court's decision. The lawyer emphasizes that since the Supreme Court had no objections to the substantive decision of the appeal court, the case will probably go to the court in Kalisz again. It's just that it will happen later.

The reason for the Supreme Court's decision was the participation of a neosal in the adjudicating panel.

– We have been withdrawn in this matter for everything that happened since the appeal. This is not good news for the family of the deceased, who has been waiting for the final decision for nearly six years – says the lawyer.

A decision that is no longer important

Let us remind you, in November last year, the Court of Appeal set aside the judgment of the first instance against the policeman Sławomir L., The accused of a deadly shooting from the official weapon of 21-year-old Adam Czerniejewski and referred the case to the court in Kalisz, for reconsideration. Why? As the judge explained in the justification, the opinions of experts who dealt with the case were contradictory. – It was necessary to confront these experts – he emphasized.

The judge reminded that the appeal court cannot take all evidence, but refer to the contested part. – The starting point should be the assessment by the Appeal Court conducted by the Court of First Instance not only in terms of the need to re -conduct evidence and extra -proof activities, but also in the aspect of whether court proceedings have met the standard of reliable trial – he emphasized.

As added, “the first instance court diligently dug at the obligation to reliably verify the hypothesis of the indictment.”

– For this special knowledge was needed at the experts. The court did not benefit from this instrument, so it should be considered that when violating the principles of objectivity and the requirements of a reliable trial, the proceedings were completed and such a ruling could not stand – he explained.

Cassation on the final judgment of the Łódź Court of Appeal, reversing the case to first instance, was brought by the prosecutor's office. Investigators justified in it that the case should not be considered again, only the sentence for the accused of a policeman should be changed (interestingly, investigators wanted a lower sentence than the one who was made in the first instance).

He started running away, the policeman fired

Adam Czerniejewski died in Konin in November 2019 after a shot from police weapons. Policemen patrolling the streets of the city drew attention to the 21-year-old standing in the company of two younger boys. At the sight of the police car, Adam began to run away.

Sergeant Sławomir L. ran after him. After a few seconds you could hear a shot from a police weapon. As it turned out, the missile hit the escaping 21-year-old and killed him.

Prosecutors – as we reported on tvn24.pl as the first – had gigantic problems with recreating, which exactly happened between the blocks at Wyszyńskiego Street in Konin. Monitoring cameras they did not record the moment of the incident. The investigators had to be based on expert findings, and these were contradictory. Two specialists in forensic medicine said that Adam was hit in the front. The third expertise – a chemist from the Central Forenship Laboratory in Warsaw – indicated that Adam could get a shot in the back.

A second autopsy was needed

Only the second section and new experts determined that the shot fell up close and back.

The trial on the death of 21-year-old Adam from Konin started in November 2023 before the District Court in Kalisz. A policeman who fired a shot to the 21-year-old was accused of inadvertently causing death. He threatened him from three months to 5 years in prison. He did not confess to the act of being accused.

During the first hearing, Sławomir L. turned to the father of the 21-year-old. – Mr. Arthur, I waited for four years for this moment, it destroyed me. I am so sorry that your son is dead. I hope that knowing this will be easier for you – said the accused policeman.

The word “sorry” did not fall from the mouth of the accused. “No policeman never told me in my life,” said Mr. Artur, Adam's father.

The policeman returned to service

Adam died on the hands of Sławomir L. – Since then, there is actually no day so that I would not see that moment when he was leaving, looking in my eyes. I kept his face, screamed at him so that he would look at me so that he would not fall asleep – said the accused during the trial.

After 11 months sick leave And the help of psychologists a policeman returned to service. – In four years he did not receive any awards. He was not promoted – Michał Wójcik, defender Sławomir L. informed during the appeal process, adding that after the incident of 2019 the course of service was absolutely correct.
