On May 29, President Andrzej Duda signed the act called “lex Tusk”, and it entered into force on May 31. On June 2, the president unexpectedly announced the draft amendment to the act. MPs discussed it on Tuesday. – It should be titled the act on disgrace – assessed Borys Budka (KO). – With the law that you have already introduced, and which the president is now trying to fix, you issued a gigantic vote of no confidence in your ministers, those from the special services – said Artur Dziambor.

On Tuesday afternoon, the deputies debated the presidential draft amendment to the law on the commission for examining the Russians, known as “lex Tusk”. The first to speak was Małgorzata Paprocka from the Chancellery of the President, who explained that the changes presented by the President were the result of doubts raised in the public debate in relation to the act on commissions. Paprocka recalled that Andrzej Duda proposes, inter alia, the abandonment of the so-called countermeasures, i.e. a ban on holding public office for persons whom the commission demonstrates that they act for Russia, increasing the transparency of the commission’s activities and introducing all open meetings, as well as eliminating active deputies and senators from the composition of the commission.

On behalf of the PiS club, Piotr Kaleta spoke, who argued that the commission for examining Russian influence is a “truth commission” and it should be established. In his opinion, the commission is so criticized by the opposition because “there is a huge fear of getting to the truth.” Kaleta stated that the presidential amendment is an opportunity for the opposition, because Duda took into account its most important demands towards the commission. Thanks to this, he said, the opposition “could stand in the truth”. “Those who have nothing on their conscience will not be afraid of this commission,” he said.

Kaleta said that the PiS club would be in favor of the presidential amendment being further processed in the committee.

Then the head of the Civic Coalition club took the floor Boris Budkawho stated that “this act should be titled an act on discrediting both this part of the parliament, but also discrediting President Andrzej Duda”.

Budka maintained that “it is impossible to amend a law that is unconstitutional from the first to the last sentence.” – It is impossible to amend a law that aims only at one thing: to eliminate political opponents from public life. Szczepański: Those who voted for this law violate the constitution

Wiesław Szczepański from the Left reminded that “constitutionalists pointed out that the bill violates thirteen articles of the constitution, including the article on the principle of a democratic state ruled by law, the rule of law, and the separation of powers.”

– It also violates the principles of criminal procedures, the principle of the right to an independent and impartial court, tramples on the right to privacy and violates the foundations of the functioning of the judiciary – he mentioned. “Those who voted for this bill are violating the constitution,” he said.

Biernacki: this is the president’s abdication of his powers

Marek Biernacki, MP of the PSL-Polish Coalition, assessed that the president signed the act “in a truly sprint time, despite the information that the project raises a number of doubts”. – In my opinion, and not only, this is the president’s abdication of his powers. It is an embarrassment, but above all, an abdication of basic rights, i.e. protection of the constitution, standing in a constitutional position and protection of the separation of powers – he mentioned.

– This project (of the amendment – ed.) is not a straightening of the main project, but an attempt at camouflage to cover what is fatal in this project – he stated.

At the same time, he pointed out that the members of the commission, in addition to being investigators and judges, would have access to “the most secret information of the state”, both operational knowledge and knowledge of preparatory proceedings. The same people will – as he argued – also sentence the person they indicated to “civil death”, “stated that it does not guarantee the conduct of state affairs”.

– Being a minister in various governments, in various configurations, I did not have such access to information as commission members will have – said Biernacki, former head of the Ministry of Interior and Administration and former Minister of Justice.

Dziambor: the name Law and Justice is a grotesque name

Artur Dziambor (Freedomists), addressing the rulers, said: – With this law, which you have already introduced, and which President Andrzej Duda is now trying to fix, you have issued a gigantic vote of no confidence for your secret service ministers, Mr. Kamiński and Mr. Wąsik.

– By the way, you showed that the name Law and Justice is a grotesque name from your point of view: the law is the law when it serves the party and when the party can do whatever it wants with this law, he noted.

Speaking on behalf of the Confederation circle, MP Krzysztof Bosak assessed that the creators of the law on the commission “are ridiculing the Polish state and parliament”. “If you wanted to track the influence of other countries, not just Russia, you had eight years to do it,” he noted.

– What cynicism was behind the fact that some receipts were hoarded for the duration of the election campaign? – He was asking. – If you had examples of breaking the law, you had an obligation to report to the prosecutor’s office and hold the guilty accountable. If you have evidence of foreign influence, not only Russian, which is not a violation of the law, and you have concealed it, you are to blame, he added, addressing the applicants of the commission.

Tomasz Szymański (KO), addressing the observers of the parliamentary debate, assessed that they are “witnesses to a failed attempt to powder a corpse on a burning ship, which inevitably goes to the bottom.” – And why is this happening? Because the president first got a scolding from the US State Department, then he got a scolding from the European Commission, and finally he read this bill and grabbed his head. And now we have a real problem, he said.

– You can’t fix it with our hands, because it can’t be fixed. It’s not worth a pound of lint, he said.
