During the party convention, acting chairman of the Civic Platform Party, Donald Tusk suggested to the president of PiS, Jarosław Kaczyński, to enter into the constitution a provision that the termination of an international agreement takes place by a two-thirds majority. Prime Minister Mateusz Morawiecki commented on this proposal. – We certainly don’t say no. I say unequivocally that it is possible – he said.
During Saturday’s national convention of the Civic Platform in Płońsk, the party’s leader Donald Tusk proposed to PiS chairman Jarosław Kaczyński to jointly amend Art. 90 of the Constitution and stating that the termination of an international agreement is effected by a majority of two-thirds.
– It is a very simple undertaking – emphasized Tusk. In his opinion, an appeal in this matter should come from every Polish town that benefited from the Polish presence in the Union. – Please agree to the joint venture immediately – a minor change in the constitution that will avoid the risk of leaving the EU for Poland at night – said Tusk. Prime Minister Mateusz Morawiecki commented on this proposal on Saturday in Dąbrowa Tarnowska.
Morawiecki replies to Tusk on the change of the constitution: we do not say “no”
Prime Minister Mateusz Morawiecki assessed that “sovereignty cannot be surrendered only because someone misinterprets the treaties”. – The treaties clearly define which competences are the competences granted by the sovereign, i.e. the Member States of the European Union – he explained his position. “We demand absolute compliance with the treaties,” he added.
– Apart from the propaganda aspect of this problem, of course we are undertaking a substantive discussion on this subject. We certainly don’t say no. I am saying unequivocally that it is possible – said the prime minister.
He stated that he would like to take into account “simultaneously those judgments of the Constitutional Tribunal that have already been handed down, from 2005 or 2010”. – And I ask Mr. Tusk and the Civic Platform if they are aware of what these judgments contain? Whether in these judgments the decision on the superiority of the Polish constitution over the European treaties will be respected by the Civic Platform – Morawiecki wondered.
– The Constitution is the highest law of the Republic of Poland and we must all know about it – he added.
Fogiel: despite the propaganda nature of the proposal, PiS authorities will focus on the topic
Earlier, Deputy PiS spokesman Radosław Fogiel referred to Tusk’s proposal. “We are obviously aware that this is a propaganda trick, but the proposal to amend the constitution is a far-reaching proposal. If we were to talk about it, there are other issues that, according to Law and Justice, should be included in the constitution,” he said.
“There are certain issues already regulated, for example, by the judgments of the Constitutional Tribunal, which should be included directly in the constitution. Therefore, despite the propaganda nature of the proposal, once it was made, the relevant PiS authorities will deal with this subject” – added the PiS vice-official.
