In 2025, the National Day of the Third May falls on Saturday. This does not mean, however, that employees will be lost. We explain on what terms you can pick it up.
Additional day off
In Poland, we have 14 holidays that are public holidays during the year. Earlier there were 13 of them, but from 2025 a day off from work is December 24, i.e. Christmas Eve.
In 2025, Labor Day falls on Thursday, May 1, and the National Day of the Third May on Saturday. Does this mean that one of the public holidays is lost to employees employed full -time?
According to the Labor Code, if the holiday is free from work on a day other than Sunday, it lowers us working time by 8 hours. Therefore, employees have the right to receive a day off this year.
We are also entitled to lower working time by 8 hours if Saturday was not working in our case.
Day off for Saturday
The employee does not have to submit any application to collect an additional day off. At the same time, the employer decides when he will admit this day. This term has the right to determine top -down and it depends only on it whether all company employees will receive a day off at the same time or on different days.
It is worth remembering, however, that the employer cannot grant a few hours free a day instead of the whole day outside of work – the number of non -working days in a given settlement period must agree.
An additional day off can be granted at any time in a given settlement period, both after and before the holiday. For example, if the billing periods are monthly, it means that we should receive a day off in the same month in which there was a holiday.
Up to PLN 30,000 penalties
What if the employer does not agree to grant an additional day off for a holiday on Saturday? In this case, it risks obtaining a fine of 1 to 30 thousand. zloty. In addition, failure to receive a day off would mean exceeding the norm of the work by the employee, and thus – the need to pay him an overtime allowance.
A day off for a holiday on Saturday is not entitled to persons working on contracts other than employment contracts (e.g. mandate contract, work contract), as well as performing some professions, e.g. teachers.
In Poland in the fourth quarter of 2024 93.5 percent employees worked full -time – according to the study of the Central Statistical Office (CSO). It was 16 million 127 thousand. people. However, 1 million 120 thousand (i.e. 6.5 percent) worked part -time.
