Retired judge Anna Maria Wesołowska described on social media a situation from the past when she recommended prosecutor Dariusz Barski to the then Minister of Justice Zbigniew Ziobro. “He was always prepared and specific. Today I wonder what happened to the man I valued so highly,” she said. “You have become a politician, partly because of me,” she said to Barski.

Retired judge Anna Maria Wesołowska published a post on social media on Thursday evening. “I decided to come back to talking to you in the virtual world because I feel a little guilty about today’s situation,” she began her entry.

“Let’s start with memories. In 2005-2006, I ruled in a high-profile case of an organized criminal group, the so-called ‘Octopus’, I continued investigating corruption in the broadly understood justice system, I started recording the program ‘Judge Anna Maria Wesołowska’. The then Minister of Justice, Mr. Zbigniew Ziobro , asked me for consultation on introducing changes to the law that would make it possible to deprive the mafia of its financial support. For me, a judge, people have no political colors, what matters is whether they want to do something good for others. I also wanted to weaken organized crime, so late in the evening The TVN driver took me to a meeting with the minister,” wrote Anna Maria Wesołowska.

As she assured, “they talked substantively.” “I said that I would be happy to help because the assumptions were noble, but I stressed that I did not like the minister’s methods of operation. I heard: ‘I have to act like a tank as long as I am a minister, because this position is not certain.'” Indeed, it was not. After a few months, he lost it. When we were saying goodbye, the minister asked if I knew any prosecutors who were decisive and professional. I probably mentioned three names of prosecutors with whom I worked on a daily basis. One of them was Dariusz Barski – always prepared, specific. – described the judge.

“Today, when I hear that he illegally filed a complaint to the Constitutional Tribunal, to the president, who hugs legally convicted people in front of the citizens, I wonder what happened to the man I appreciated so highly,” said Judge Wesołowska.

As she wrote, “a judge, a prosecutor – it sounds proud, it’s a mission to serve society.” “Everything else is a function, i.e. a stool that is not worth holding on to at all costs. A president who calls for the admission of legally convicted persons to the Sejm sessions, and invites criminals to the Presidential Palace, has not much to lose, but prosecutor Dariusz Barski is a good lawyer , he already knows that he was appointed illegally,” said Anna Maria Wesołowska.

“The protective order issued by the Constitutional Tribunal in the person of Ms. Krystyna Pawłowicz does not protect the prosecutor against removal from office. It is invalid because she was also incorrectly appointed due to her age. So maybe it is worth saying enough to the manipulations, unless Mr. Dariusz Barski also “there is nothing to lose. If that is the case, I know that no rules will matter,” she said.

A retired judge appealed for “support” for the Minister of Justice Adam Bodnarwho “with admirable calm, listening to the opinion of legal authorities, makes decisions in accordance with the principle that law makes sense when it serves citizens.”

“The presence of criminals, even pardoned ones, in the Sejm session is certainly not in the interest of us, citizens. Mr. Prosecutor Barski, in the same courtroom several years ago we fought for a decent state in which an individual can not only enjoy the rights and freedoms guaranteed , but she is also responsible for the state, and I am asking for this sense of responsibility,” wrote Anna Maria Wesołowska.

She summed up her entry: “You have become a politician, partly through my fault, so I will end with the words of Immanuel Kant: true politics cannot take a step without first paying homage to morality. If you are no longer a real prosecutor, at least be a real politician” – she called.

Concreting of the prosecutor’s office

In 2022, Barski by decision Zbigniew Ziobro he was restored to active service and became the National Prosecutor. On Friday, January 12, the Ministry of Justice announced that this was the restoration was made without a legal basis. Therefore, as the ministry reported, he has been retired since January 12 and does not serve as a national prosecutor. The ministry announced that Jacek Bilewicz has become the acting national prosecutor.

He criticized the decision PIS and president Andrzej Duda, who wants Minister Adam Bodnar to withdraw from it. The deputy prosecutors general still recognize Barski as the country’s prosecutor.

Dariusz Barski is called the gray eminence of PiS by commentators on the political scene. He is a trusted person of former Minister of Justice Zbigniew Ziobro. Barski even before elections as a national prosecutor, he gained extensive competences.

– When it turned out that the election was going to be lost, it was decided that the prosecutor general should be deprived of all powers to do anything and these powers were transferred to the national prosecutor – commented former Minister of Justice, Prof., on TVN24. Zbigniew Ćwiąkalski. – Of course it is unconstitutional – he adds.

– After the changes introduced by PiS, the national prosecutor cannot be dismissed because this requires the consent of the president. – At the end of the government, a system was built to provide a lonely island that the new government would not be able to recall – explained Prof. Maciej Gutowski from Adam Mickiewicz University in Poznań.

Barski was not only Zbigniew Ziobro’s subordinate, but also has social ties with him. – He was a witness at his (Zbigniew Ziobro’s – ed.) wedding. We are dealing not only with official subordination, but also with a certain social and friendly dependence – recalled the former national prosecutor and former head of Ministry of Interior and Administration Janusz Kaczmarek.
