Beata K., singer of Bajm, convicted – the sentence is not final, the prosecutor’s office announces an objection

Six months of community service plus five years’ driving ban. The court issued a prescriptive sentence in the case of the well-known singer Beata K., who was driving under the influence of alcohol. The verdict is not final and the prosecutor’s office has already announced an objection.

The information about the decision of the District Court for Warsaw-Mokotów was provided to us by Beata Adamczyk-Łabuda, spokeswoman for the District Court in Warsaw. As she informed, a prescriptive sentence was issued in the case (it is issued in closed session without the participation of the parties).

Prescriptive sentence for the singer

– The decision was made on October 29, 2021. The District Court for Warsaw-Mokotów found Beata K. guilty of the alleged acts and sentenced her to six months’ restriction of liberty with the obligation to perform unpaid, controlled social work for 20 hours and a ban on driving any motor vehicles for a period of five years – she said.

Moreover, the court ordered her to pay PLN 10,000 to the Victims’ Aid Fund and the Post-penitentiary Assistance. The court found that, on the basis of the collected evidence, “the circumstances of the accused’s act and guilt do not raise any doubts.”

Beata Adamczyk-Łabuda pointed out that the sentence is not final. – The parties have the right to raise objections to the court which issued the judgment within seven days of the delivery of the description – she said. In this case, the parties have until midnight on November 15th.

As the spokeswoman said, such a letter has not yet reached the court, but the prosecutor’s office has already announced an objection. – The prosecutor’s office will raise an objection to the judgment. In the opinion of the public prosecutor, the sentence imposed on the accused is grossly disproportionate to the circumstances of the act – the state of intoxication, as well as the degree of threat to safety caused by the defendant’s behavior – said Aleksandra Skrzyniarz, spokeswoman for the District Prosecutor’s Office in Warsaw.

This means that the process will be restarted as normal.

She said she had drunk about a liter of wine

The incident took place on September 1 in Mokotów. Other drivers informed the police that the driver of a BMW might be intoxicated. A pair of witnesses traveling in the same direction as the singer noticed that the vehicle she was driving chaotically changed lanes and was approaching very close to the vehicles. According to one of the interviewed persons, the BMW was also driving over curbs. The incident was recorded by a passenger of another car. It was the witnesses who prevented the artist from leaving the intersection of al. Niepodległości and ul. Batory until the arrival of the police.

While still at the scene, K. told the policemen that the day before she was at a meeting which ended around 2 am. It was then that she was supposed to consume wine, according to her account, she drank about a liter of alcohol. At the police station, during the questioning as a suspect, she pleaded guilty but exercised the right to remain silent and answer questions.

Immediately after the detention, the test showed two per mille of alcohol in the air exhaled by the artist.

After all, she made a statement

On September 2, the singer of the band Bajm issued a short statement. On social media she wrote: “Beloved, I’m sorry everyone. I know that I let you down. I regret with all my heart what happened yesterday. I am very ashamed of it. I know that I have to bear the consequences of what happened. I am ready for it.” .

No preventive measures were taken against her, and after the incident, the police only secured her driving license. The artist had not been punished before.
