As obviously unfounded, the Supreme Court dismissed the defense attorney’s cassation appeal against the final sentence of 25 years in prison against 44-year-old Mariusz P. The man was convicted of rape and the related murder of a 30-year-old nurse, Agnieszka D, who was attacked and brutally raped in one of the housing estates in Białystok. . The crime took place in August 2001. The man was arrested 20 years later thanks to the work of policemen from the X-Files.

The court dismissed the cassation appeal as obviously groundless – according to information obtained from the Supreme Court. The case was heard at a meeting without the participation of the parties.

She died after a few months

The crime took place on an August evening in 2001 in the Sienkiewicza housing estate in Białystok. The victim was 30-year-old Agnieszka D., a nurse working at a children’s clinical hospital.


The perpetrator strangled her, tied her hands with pieces of clothing and tried to gag her. When she lost consciousness, he raped her. As a result of her injuries, the 30-year-old died after a few months in hospital.

Initially, the perpetrator could not be identified

The attack took place right next to the block where she lived. It happened after she walked her cousin to the bus stop. In the ongoing investigation at that time, the perpetrator of the rape, robbery (the prosecutor’s office assumed that the victim had been robbed of jewelry) and murder could not be identified. In 2020, however, police officers from the so-called The X-Files, dealing with difficult, unsolved criminal cases, and the District Prosecutor’s Office in Białystok.

In mid-2021, the suspect was arrested in Great Britain. It turned out that he had been living there with his wife and three children for several years. He was handed over to Polish law enforcement authorities at the end of February last year. Then he was charged with rape, murder and robbery.

The prosecutor’s office wanted a life sentence

Both during the investigation and in court, the 44-year-old pleaded not guilty. The main evidence against him was DNA evidence. They identified the accused after comparing the data with the British database, because the man had a criminal record there.

Before the District Court in Białystok, the prosecutor wanted life imprisonment, the defense wanted acquittal. In January 2023, this court illegally sentenced the defendant to 25 years in prison with the reservation that he will be eligible for parole after 20 years. The court awarded a total of PLN 300,000 to the deceased’s parents. PLN compensation.

The court considered biological traces to be crucial evidence

Both sides filed appeals. In the appeal, the defense wanted, first of all, a change in the legal classification of the act and a milder punishment, it questioned the charge of murder and also requested a significant reduction in the amount of compensation. The prosecutor’s office considered the 25-year prison sentence to be grossly lenient and again demanded a life sentence.

The Court of Appeal in Białystok found both appeals groundless and dismissed them, upholding the judgment. This court also considered biological traces to be key evidence, pointing to the accused with a probability bordering on certainty.

He found the legal classification of murder with possible intent and the sentence of 25 years in prison, with an aggravated sentence, i.e. with the possibility of applying for conditional early release after 20 years, to be correct.
