15 years of imprisonment – this was the sentence received by a 52-year-old man who was illegally convicted of a murder that occurred in 1992 on Żelazna Street in Białystok. It was there that the body of a man with a stab wound to the abdomen was found. Years later, the suspect was identified thanks to the cooperation of investigators and policemen from the X-Files. Now the case has gone to appeal. The first hearing will take place in April.

In the first instance, the prosecutor’s office wanted 25 years in prison, while the defense asked for acquittal of the charge or for a possibly milder penalty.

The district court in Białystok sentenced the 52-year-old defendant to 15 years in prison. The defense attorney appealed against the verdict. The case files were transferred to the appellate court in Białystok. The case is scheduled to be heard in early April.

A man was found with a stomach wound

The crime took place in May 1992 at Żelazna Street in Białystok, where the body of a 40-year-old man with a cut wound to the abdomen was found. Initially, the investigators’ work did not bring any breakthrough in the case and it was discontinued after a year.

At that time, there was insufficient evidence to explain the circumstances of the man’s death.

In the spring of 2022 – on the initiative of the District Prosecutor’s Office in Białystok – the case was brought to the attention of police officers from the 10th Archives of the Provincial Police Headquarters in Białystok. The use of the latest research methods led to the identification of the person suspected of committing the murder.

For this purpose, the following were used, among others: genetic testing and psychological profiling of the potential perpetrator.

He left work and was arrested

In September 2022, the police reported that The then 50-year-old man fell into the hands of counter-terrorists in the Białystok housing estate moments after he left work. He was brought to the District Prosecutor’s Office in Białystok, where he was charged with murder in the context of recidivism.

Court verdict more than 30 years after the crime

The prosecutor’s office accused him of murder with direct intent. According to investigators, during an argument and struggle, he stabbed the victim in the stomach with a knife. It all happened in a group of people who met and drank alcohol together.

The court of first instance assessed that guilt was beyond doubt, but the perpetrator acted with a possible, not direct, intention to kill. The most important evidence – apart from the opinion of an expert in the field of genetics and forensic medicine – included the testimony of several people and some of the explanations given by the accused himself, already submitted during the second investigation; it’s about admitting to stabbing him once. The accused talked about the sudden attack on him and the need to defend himself.

The court sentenced him to 15 years in prison on the basis of the current Penal Code, and not the provisions in force when the crime occurred, when the death penalty was still included in the then code and in force – although it was no longer carried out. He also took into account that the 52-year-old’s conviction for the murder of his then partner had already been expunged, which means that he is treated as a person with no criminal record in this trial.
