Both sides appealed in a famous process regarding the accident at the crossroads of Towarowa with Łąkowa in Bialystok. In the first instance to a year in prison, a policeman was sentenced to two years, who was supposed to force the right time. In the accident, a 23-year-old was seriously injured who died after two months in the hospital.

The prosecutor's office wanted suspended penalties for all drivers
The prosecutor's office charged all three drivers. The Opel driver alleged that – joining the traffic – he unintentionally violated the principles of road safety, he did not give way to the priority of the BMW driver, leading to an accident in which the BMW passenger suffered fatal injuries.
The bus driver was accused that he did not exercise particular caution and inattentively watched what was happening on the road, because he used a mobile phone at that time, did not see the BMW collision with Opel and was late with taking a defensive maneuver, which led to the collision of the bus from BMW.
On the other hand, the BMW driver was accused of driving too quickly (according to the assessments of experts appointed in the investigation, at a speed of nearly 100 km/h), which led to a collision with Opel and the effects of this accident.
The prosecutor's office wanted suspended penalties for all three accused, also for all three, temporary prohibitions of driving all vehicles. They were also to pay 10,000 PLN as part of partial compensation to the mother of the deceased 23-year-old.

After a long trial and supplementing the proceedings with additional expert opinions, in October 2024, the District Court in Bialystok unlawfully sentenced the policeman driver to a year in prison suspended for two years. The man also got a annual ban on driving vehicles.
The judgment shows that the direct cause of the accident was the behavior of the Opel driver, who inadvertently violated the rules of safety in motion, did not give way to the journey and this way led to this accident. The court also assessed that the BMW driver and bus only committed traffic offenses. First – exceeded the speed limit, the second used the phone while driving. The proceedings against both were discontinued due to the limitation of criminal record.
According to information from the press office of the District Court in Bialystok, both parties made appeals from the judgment. Both the defender of the convicted policeman and the prosecutor's office, who appealed against the judgment against all three of the accused.
