Biedronka returns money to customers. Effect of UOKiK decision on “Magic of discounts”

Some customers of the Biedronka chain of stores are entitled to receive a voucher worth PLN 150 for the entire assortment as part of a one-time purchase – according to a message shared on the store's website. This is the result of a decision by the Office of Competition and Consumer Protection, in connection with the store's promotional campaign, which “violated the collective interests of consumers”.

The Biedronka chain of stores was obliged by Office of Competition and Consumer Protection to award its customers new vouchers worth PLN 150, which can be used to purchase any products. The voucher will be valid for one year.

The additional PLN 150 is awarded to Biedronka customers who made purchases as part of the “Magia Rabatów” promotional campaign between December 1 and 3, 2022, received a promotional voucher but did not use it and are still in the chain's loyalty program.

“Customers who received a voucher as part of the promotional campaign “Magic of Discounts – Toys and Books – Voucher from 01.12.2022 to 03.12.2022” and it was not used by them in due time, regardless of the reason, are entitled to receive a voucher worth PLN 150 for the entire assortment as part of a one-time purchase (excluding: alcoholic beverages, tobacco products, infant formula and all services or top-ups, including phone top-ups, gift cards or gift card top-ups), regardless of their value, valid for one year from the date of its receipt (without the possibility of exchanging it for cash) – we read on the Biedronka store website.

Vouchers from Biedronka as compensation. How to get them?

In the case of participants of the Moja Biedronka loyalty program, the matter is simple, because they should receive an automatic refund on the Moja Biedronka card they used during the promotion.

However, customers who have opted out of the program are asked by the store owner to contact them. “Customers who took part in the aforementioned promotional campaign and then opted out of the Moja Biedronka program are asked to contact the Customer Service Office by phone at: 800 080 010 (from a landline – free call) or (22) 205 33 00 (from a mobile phone or from abroad – call fee according to operator rates/price lists) or by e-mail at: bok@biedronka.pl” – we read in the announcement.

However, they will be required to provide the store card number used when making purchases in the aforementioned promotional campaign or provide a receipt confirming the use of the aforementioned promotional campaign.

UOKiK decision on granting funds by Biedronka

The Office of Competition and Consumer Protection issued a decision on April 8, 2024 regarding the “Magia rabatów” promotion. The campaign took place between December 1 and 3, 2022, and as part of it, Moja Biedronka loyalty card owners were encouraged to buy three products from the book and/or toy category. They were then to receive half of the amount spent on these products in the form of a voucher to be used for subsequent purchases.

It follows from this that Jeronimo Martins Polska Spółka Akcyjna with its registered office in Kostrzyn, owner of the Biedronka chain of stores, used practices that violated the collective interests of consumers in the indicated promotional campaign by “failing to provide consumers with clear, unambiguous and timely information on the rules for redeeming the voucher, which misleads consumers as to the actual conditions for using the voucher as part of the promotion and may therefore constitute an unfair market practice”.
