The District Court in Ostrowiec Świętokrzyski did not agree to arrest Piotr M. The 38-year-old is suspected of causing an accident in which five people died. He was drunk and on drugs.
The prosecutor’s office announced that it would appeal against the court’s decision. The refusal to arrest was justified by the suspect’s health condition.
The accident on the national road No. 9 in the town of Boksycka in the Ostrowiec district took place before 5 on Sunday. According to police findings, a 38-year-old man who was driving a Mercedes passenger car probably lost control of the vehicle, drove to the opposite lane, where he collided head-on with a Fiat driven by a 72-year-old man. Five other people, aged 16 to 43, were traveling in the Fiat.
As a result of the accident, a 38-year-old from the Mercedes and a 16-year-old from the Fiat were taken to the hospital. Three men aged 19, 43 and 72 and two women aged 18 and 38 died on the spot.
The victims of the accident were related to each other, they were residents of the Ostrowiec and Opatów counties. The 38-year-old Mercedes driver was arrested on suspicion of causing the accident.
Drunk and drugged driver
According to the prosecutor’s office, the driver of the Mercedes was driving under the influence of alcohol and drugs. His blood was drawn for alcohol and drug testing.
On Monday evening, the prosecutor charged Piotr M. with causing a fatal road accident while intoxicated and under the influence of drugs. Interrogated as a suspect, Piotr M. did not respond to the allegation and exercised his right to refuse to give explanations.
On the same day, the prosecutor submitted to the District Court in Ostrowiec Św. an application for the temporary detention of the suspect for a period of three months. Daniel Prokopowicz, spokesman for the District Prosecutor’s Office in Kielce, said on Wednesday that the Ostrowiec court rejected the prosecutor’s request.
– The court, justifying the decision, referred to the state of health of the suspect. The prosecution in this case had a different opinion. We will, of course, appeal against this court decision not to pre-trial detention for Piotr M. We just need to read the justification for this decision – stressed Prokopowicz.
