The perpetrator of the fatal accident in Brzeziny (Świętokrzyskie Voivodeship) will be arrested for three months, the District Court in Kielce decided on Friday. The man was driving with a blood alcohol content of over two times the legal limit and a previous drink driving ban.

The prosecutor’s office charged the perpetrator of the accident with driving a car while intoxicated and during the driving ban issued for the same reason, as well as causing a fatal accident. She applied to the District Court in Kielce for the temporary arrest of Mariusz M. However, the court initially refused the request and banned the suspect from leaving the country. The prosecutor’s office appealed against this decision.

On Friday, the District Court in Kielce decided that Mariusz M. would be placed in pre-trial detention for three months. “The district court imposed on the suspect a ban on leaving the country, combined with the seizure of his passport. This decision was repealed, and in its place, the district court ordered the suspect to be placed in pre-trial detention for a period of three months,” said Judge Jan Klocek, spokesman for the District Court in Kielce.

“The main reasons for applying this measure are, of course, the high penalty that the suspect faces, but also the fact that there is a fear of persuading witnesses to testify in their favour,” added the judge.

In the court’s opinion, there was also a risk that Mariusz M. might hide from the justice system.

He swerved into the opposite lane and hit two cars

The tragic accident happened on July 6. Mariusz M., driving a Chevrolet Captiva car, drove through the gates closed at the railway crossing in Brzeziny, drove to the opposite lane and hit the cars parked there head-on. The first of them was thrown to the side of the road and overturned. Its driver, a 58-year-old man, died at the scene. The driver of the second car waiting at the crossing was injured.

The perpetrator of the accident had more than two times the legal limit of alcohol

Blood was taken for testing from the 43-year-old perpetrator of the accident. It was established that at the time of the incident, the man had more than two times the legal limit of alcohol in his system. In addition, he already had a drink driving conviction and was therefore disqualified from driving. His license was revoked two years ago for drunk driving.

Investigation under special supervision

The Minister of Justice, Prosecutor General Zbigniew Ziobro, informed that the proceedings were under special supervision by him. He noted that “if someone gets behind the wheel with 2.7 per mille in their blood, they do it not for the first time, and despite the ban on driving, it means that they cannot stop the urge to drink, they are unimaginative and dangerous.”

The perpetrator of the accident is liable to a total penalty of 17 years in prison.
