According to the police findings, the 43-year-old driver of the Chevrolet, driving from the direction of Morawica, for undetermined reasons, swerved to the opposite lane, first hit the already abandoned turnpike at the railway crossing, and then collided head-on with an Opel Corsa. The force of the impact was so great that the Opel hit two other cars behind it – a Renault and a Kia.

The 58-year-old man from the Opel died at the scene. The Chevrolet and Renault drivers were taken to the hospital with serious injuries.

Blood was taken for testing from the 43-year-old perpetrator of the accident. At the time of the incident, the man had more than two times the legal limit of alcohol in his system. Additionally, the man had an active driving ban. His license was revoked two years ago for drunk driving.

Two charges

The 43-year-old was charged with: causing a fatal accident while intoxicated. The second charge is related to driving while intoxicated during the period of the court’s driving ban. The man faces a total sentence of 17 years in prison.

Court: no fear of subterfuge

The prosecutor’s office requested the man’s pre-trial detention, pointing to the fear of subterfuge, because it is still necessary to question more witnesses, and the fear of hiding and escaping of the suspect who works abroad.

The court did not accede to this request. – The court assumed that in this case there is no fear of procedural collusion – said the spokesman for the District Court in Kielce, Judge Tomasz Durlej. – The suspect confessed to committing the alleged crimes. In the court’s opinion, the use of pre-trial detention would be inadequate. A ban on leaving the country, combined with the seizure of the passport, will be a sufficient measure, the judge pointed out.
