At the Monday session, the District Court in Oborniki (Wielkopolska) discontinued the criminal proceedings against three – out of six – defendants in the case of building the so-called castle in Stobnica. The controversial investment is being built in the Natura 2000 area. The main argument of the defense, accepted by the court, was that it is not a matter for a criminal court, but an administrative one. Similar motions submitted by the other three accused will be considered in a separate session. The indictment was filed with the court in December 2020.
Construction of the so-called The castle in Stobnica is an investment of the Poznań-based DJT company, carried out in the Natura 2000 area. The multi-family building under construction on the edge of the Noteć Forest is to have 14 above-ground floors and a tower of several dozen meters. In August 2018, the Minister of the Environment instructed the General Director for Environmental Protection to initiate an urgent inspection of the construction decision process. The prosecutor’s office was also notified in this case.
At the end of 2020 the prosecutor’s office filed indictments with the court against persons “whose activities are related to the implementation of an illegal investment consisting in the construction of a residential and utility building in the protected area of Natura 2000 Puszcza Notecka. “Six people were indicted. Against the seventh, due to her death, the prosecutor discontinued the proceedings with regard to the charges against her.
Defendants in the case of the Castle
Among the accused were Paweł N. and Dymitr N., representing the company running the investment. a document certifying untrue facts, showing unreliable data on the area planned to be transformed in connection with the implementation of the construction project by lowering the size of the land area and submitting a false statement about the right to dispose of the real estate, “the spokesman of the District Prosecutor’s Office in Poznań, prosecutor Łukasz Wawrzyniak, explained to the media.
Paweł N. was also accused of carrying out activities that endanger the environment.
According to the prosecutor’s office, Waldemar S., as an architect and chief designer, acting in order to gain financial benefits, confirmed the untruth in the document by providing unreliable data on the size of the area planned to be transformed and thus helped Paweł N. to commit the alleged crime.
It has been in production for 7 years
On Monday, the District Court in Oborniki held a hearing on this matter. By the court’s decision, the criminal proceedings against Paweł N., Dmitri N. and Waldemar S. were discontinued. The main argument of the defense, considered by the court, was that it is not a criminal case, but an administrative one.
Applications for discontinuation of the proceedings were also filed by the other defendants in this case: Iwona P. – who was the construction supervision inspector in Oborniki, and Marek J. and Bernadeta G. – employees of the Architecture and Construction Department in the County Office in Oborniki. However, due to the fact that these motions were submitted by them only during the Monday session, the court excluded their case and these motions will be considered during a separate session.
Construction has been going on for about seven years.
