Changes in public media

Minister of Culture and National Heritage Bartłomiej Sienkiewicz – as the body exercising the ownership rights of the State Treasury, acting on the basis of the provisions of the Commercial Companies Code – on December 19, he dismissed the current presidents of the Management Boards of Telewizja Polska SA, Polskie Radio SA and Polish Press Agency SA and their supervisory boards. The minister appointed new supervisory boards of these companies, which appointed new management boards.

The decision of the head of the Ministry of Culture and National Heritage was criticized by PiS politicians who defend the propaganda mouthpiece they created. Also the president Andrzej Duda stated that there had been a violation of the constitution.

The changes in public television were commented on by the Helsinki Foundation for Human Rights in a statement. “The current way of functioning of Polish Television, Polish Radio and the Polish Press Agency clearly contradicted what public media should be in a democratic state ruled by law,” the institution stated in its position. However, she also added that “the way in which changes in public media are initiated raises serious legal doubts.”

Since December 20, i.e. since the changes began, Law and Justice politicians who do not agree with the changes introduced by Sienkiewicz have been staying in the public media offices. They claim that they carry out parliamentary interventions, but politicians of the parliamentary majority and lawyers have doubts whether the law is not broken during these interventions. The recordings show, among other things, pushing and impersonating police to enter the public media room.

December 28 PiS spokesman Rafał Bochenek said in a statement sent to PAPthat due to the formal and legal situation Law and Justice is changing its method of operation and will not be on duty as part of parliamentary interventions at PAP at this time. However, he did not rule out conducting such duties in the future.

Meanwhile, Bartłomiej Sienkiewicz decided on December 27 to put into liquidation the Polish Television, Polish Radio and the Polish Press Agency. This happened – as he explained – in connection with the president’s decision to suspend financing of public media.
