The adopted amendment to the Labor Code implements two directives: on work-life balance for parents and carers and on transparent and predictable working conditions. – The changes proposed in the Labor Code are historic – commented the Minister of Family and Social Policy Marlena Maląg in the Sejm.

The Minister of Family drew attention to the recent changes in the Labor Code. She informed that on February 21, solutions regarding the control of sobriety of employees will come into force. Minister Maląg indicated that on Thursday The Sejm passed an amendment to the Labor Codewhich involves the implementation of two directives: on work-life balance for parents and carers and on transparent and predictable working conditions.

Changes to parental leave

She informed that as part of these changes it would be extended parental leave – up to 41 weeks when the first child is born, and in the case of multiple births – up to 43 weeks. – This includes 9 weeks of “non-transferable” leave for the other parent – said the minister. – The next changes are to determine the height maternity allowance for the entire period of parental leave at the level of 70 percent of the allowance calculation basis. We are introducing an increase in the amount of the allowance by 2.5 percent – noted the head of the family ministry. She added that the employee will be able to average the maternity allowance for the period maternity leave and parental. – By submitting the application up to 21 days after giving birth, the maternity allowance for the period of maternity and parental leave will amount to 81.5 percent of the allowance calculation basis – explained Maląg. In turn, the child’s father for the period of the non-transferable 9-week part of the leave will be entitled to an allowance in the amount of 70 percent. benefit calculation basis.

Carer’s leave, leave from work due to force majeure

– We are also introducing carer’s leave in order to provide care for relatives, it is 5 days of unpaid leave. There will also be a leave from work due to force majeure – 2 days or 16 hours. The employee will retain the right to half his salary here, she said. The Minister also reminded about the solutions regarding the wider use of flexible work arrangements, which will be available to parents and guardians taking care of a child up to 8 years old.

– We also introduce a ban on any preparations for the dismissal of a pregnant employee and during maternity leave or in a situation where the employee applies for leave related to parenthood – added Maląg. She pointed out that – according to the new regulations – the probationary period will be commensurate with the duration of the fixed-term employment contract. – An employee who has been working for at least 6 months will be able to apply for a change in the contract – for an indefinite period, and the employer will have to respond in writing – explained the minister. – The changes proposed in the Labor Code are historic, looking at the state’s pro-family policy – said Minister Maląg.
