According to the EFIF BIG report (one of the largest databases of maintenance debts in Poland), in the first quarter of 2022 there were over 290,000 entries. debtors for whom the state has assumed the maintenance obligation. It was calculated that each of them is in arrears on average about 44.3 thousand. PLN, and their total debts amount to PLN 12.9 billion.
Who are the maintenance debtors?
The authors of the report wrote that men are most often in arrears with the payment of maintenance payments (94% of debtors), and the most “alimonists” are in the 45-54 age group. The report shows that most of the indebted people live in Silesia (nearly 34.2 thousand people), and the total value of unpaid liabilities there is almost 1.5 billion. zloty. It is followed by the following voivodeships: Mazowieckie (30.1 thousand), Dolnośląskie (24.5 thousand) and Greater Poland (18.5 thousand). On the other hand, the lowest number of “alimeners” is in Opolskie (approx. 4.9 thousand), Podlasie (6.2 thousand), Świętokrzyskie (almost 7 thousand), Podkarpackie (7.6 thousand) and Lubuskie (9.1 thousand). .). The report reminds that a person who has been granted maintenance and does not receive due benefits has the right to apply to a bailiff for debt recovery. Additionally – provided that it does not exceed the income criterion – it may apply for money from the alimony fund by submitting an application to the commune or city office: the maximum monthly amount that can be obtained from the commune or city under the support from the alimony fund is PLN 500 per month. It was reminded that the income criterion, which co-determines the possibility of receiving such a benefit, amounts to PLN 900 net for each family member.
The unknowingly “alimoniers”
The data provided to ERIF BIG by municipalities shows that in 2020 the courts ruled the need to pay alimony to over 51.5 thousand. children, and the average amount of this benefit was approx. PLN 883.7. However, as indicated in the report by ERIF expert Aleksandra Wilczak-Grzesik, in 2020 the number of court hearings was significantly limited due to the pandemic, which may indicate that the number of children who should receive benefits is higher.
The expert noted that although the vast majority of cases of unscrupulous “alimonists” in the ERIF database are reported by municipalities, it is also possible for any private person who has a final court judgment to enter the debtors database. “Entering unscrupulous” alimonists “into the ERIF database effectively blocks, among others taking out a loan, receiving a loan or even using digital telephony services and multimedia platforms, and what is more – it can be an ideal incentive to regulate liabilities, and thus – increase the child’s comfort of life “- she added. She emphasized that “such action is important for increasing the security of transactions on the financial market, as it reduces the risk of buying goods and services by fathers whose maintenance debts are subject to priority enforcement, which often places other creditors of such persons, such as financial market institutions in a long line of debts waiting to be paid. “
The report reminds that on December 29, 2021, the Act amending certain acts related to family benefits entered into force, which allows for the transfer of data on maintenance arrears to BIG databases regardless of the date of their creation. The result is an avalanche increase in the number of debts added in databases: in the first quarter of this year, they were added by 318%. more than in the first quarter of 2021, by 206 percent. more than in the corresponding period of 2020 and by 295 percent. more than in Q1 2019
It was also noted that in the last six years the cost of bringing up one child increased from approx. 176-190 to approx. PLN 250 thousand. zloty.
