Compensa Towarzystwo Ubezpieczeń na Życie is to pay compensation to consumers

According to Monday’s announcement the office of Competition and Consumer Protection (UOKiK), the insurer is to notify consumers that they can cancel changes to the contract made without their consent and recover premiums for additional protection.

“The President of UOKiK issued a decision against Compensa Towarzystwo Ubezpieczeń na Życie. The allegation concerned the offer sent to consumers on the anniversary of the insurance. It was an extension of the scope of cover, e.g. for hospitalization as a result of an accident, in exchange for a higher premium. The company required that persons not interested with the offer, they notified her of this,” the Office said. As it was added, consumers who did not do so, and paid the premium in the current amount, were informed about the underpayment and requested to pay the missing amount. “Such important changes to the insurance contract, such as extending its scope and increasing the amount of the premium, require the consumer’s express consent. In no case can it be considered a lack of reaction to the letter. The entrepreneur cannot burden the consumer with the need to take action on an offer that he does not is interested” – said Tomasz Chróstny, President of UOKiK, quoted in the communiqué.

The Office indicated that in the decision Compensa was obliged to discontinue the challenged practice and remove its effects. “Thanks to this, she avoided a financial penalty. Consumers whose insurance contract has been changed without their express consent may submit a request for cancellation of the changes. In this situation, Compensa will refund them the equivalent of the collected premiums for additional protection or credit them to subsequent payments” – it was stated. As it was added, this applies to both the company’s current customers and persons whose insurance contracts have already expired.
