On Tuesday, the government adopted a draft law establishing the Protective Vaccination Compensation Fund, the Ministry of Health reported. The fund is to provide patients with the possibility of obtaining a cash benefit in the event of an adverse vaccine reaction.
The draft amendment to the act on preventing and combating infections and infectious diseases in humans was prepared by the Ministry of Health.
Under this regulation, it has, inter alia, Establish a Protective Vaccination Compensation Fund, providing patients with legal means that enable them to quickly obtain cash benefits in connection with the adverse effects caused by the administration of the vaccine. Compensation benefits will be obtained by way of an administrative decision of the Ombudsman for Patients’ rights within the maximum 60-day time limit for considering the application. The compensation benefit will be a lump sum. Its amount will depend primarily on the length of the hospitalization period, with the lower limit of the compensation benefit being PLN 10,000. PLN in the case of hospitalization from 14 to 30 days, and the upper one 100,000. PLN in case of hospitalization lasting more than 120 days. In the case of an anaphylactic shock requiring observation in a hospital emergency department or an emergency room or hospitalization for up to 14 days, the benefit will be PLN 3,000. zloty. The compensatory benefit will cover adverse effects that occurred as a result of vaccinations carried out after December 26, 2020, in the case of vaccinations against COVID-19, i.e. those that occurred before the law came into force, and other vaccinations carried out from January 1, 2022. The main source the fund will be financed by payments to its bank account, made by pharmaceutical companies, wholesalers that have concluded an agreement with the State Treasury for the supply of vaccines for the performance of mandatory preventive vaccinations carried out under the preventive vaccination program
