Today, the Court said that no one and nothing can limit the president in his decision on the law of clemency. Therefore, tomorrow the president may pardon all members of the Law and Justice party – both for past and future crimes – said Professor Marcin Matczak from the Faculty of Law and Administration of the University of Warsaw in “Fakty po Faktach” on TVN24. In this way, he referred to the ruling of the Constitutional Tribunal related to the pardoning of Mariusz Kamiński and Maciej Wąsik years ago before the verdict became final.
Constitutional Court stated on Friday thatthe power of pardon is the exclusive and uncontrollable power of the president“, and the Supreme Court “has no competence to exercise control” over this action. Matczak referred to his own previous comment on thiswhen he said that “pardoning an innocent person, i.e. not convicted by a final judgment, is the same as giving a divorce to your fiancé.” – Today, the Tribunal said that not only can a divorce be granted to a fiancé, but a divorce can be given in advance even to those who do not think about getting married – said the lawyer.
