The Central Port of Communication has so far bought just over half of the land for a new airport – Maciej Lasek, the Government Plenipotentiary for CPK. He added that he hopes that new regulations will enter into force by the end of June, which will speed up the investment.
– Looking at the area, we have over 50 percent purchased land for future airport. For the owners of these 45 percent We have prepared the land for the airport amendment to the CPK Act – said the Government Plenipotentiary for CPK and Deputy Minister of Infrastructure Maciej Lasek.
It is a draft amendment to the Act on the Central Communication Port, whose assumptions were published this week in the list of legislative work of the government.
85 percent of the advance
– The law we prepared meet the expectations of property owners who have not started to buy voluntary program. We realize their postulates. These people were most afraid that in the process of expropriation they would be waiting for compensation for years, and we want to propose, however, that before they spend their property, they will get 85 percent. advances of compensation determined by the voivode. Will they win more in court? This will of course depend on their arguments – said Lasek.
He added that when the location decision became final, CPK becomes the owner of the land and the expropriation process occurs.
The novella also assumes regulations improving the investment process. CPK will be able to start preparations for construction works earlier, primarily in the field of administrative arrangements. It comes, among others for obtaining necessary documents, including building permits.
The representative emphasized that the applicable CPK Act does not regulate what the expropriation procedure for the future airport should look like.
– It is known that expropriation is always the biggest problem of every public purpose investment. That is why we have prepared a bill, where we are specified in this process, and at the same time we offer regulations that are beneficial for people from the areas of future investment as well as for CPK – explained Maciej Lasek.
“We have a lot of successes”
He added that the company has worked over the past year to take over as many real estate as possible for the construction of CPK under the voluntary program to buy.
– We have a lot of success. The program was very popular. We purchased almost 95 percent. all inhabited real estate, built -up at the future airport. For me, this is one of the most important things, because looking at it from such a universal point of view, people who lived there, arranged with the company, sold their real estate for the best offer that the company could offer them. And they can buy or build in a different place; They got the money immediately, and the deadlines for leaving the property were half a year, in one case even a year – said Lasek.
He stipulated that this does not apply to all real estate.
– A small part of the owners decided that they prefer to wait for the expropriation procedure. This applies especially to arable field owners. There are still about 20 real estate in this area, where their owners have not signed arrangements with the company in terms of PDN. And for the sake of these people, we found that the act had to be changed to give them better conditions – said the representative.
He reminded that according to the applicable CPK Act, when the location decision, which the voivode is issued, becomes final, the company is in possession of the land, and the voivode is just time to determine the amount of compensation that should be paid to the expropriated person.
– We proposed a different solution – that the voivode, at the time when the location decision becomes final or the company is about a rigor of immediate enforceability, would be obliged within 30 days to prepare the value of compensation, so that everyone, before issuing the property, has the right to at least 85 percent. Advances of this compensation – explained Lasek.
In his opinion, in the “CPK Act on the CPK, the terms of expropriation were the worst when it comes to all the laws.” – Together with the company, we worked for a few months on the solutions to secure residents – he said.
Lasek added that the project also provides for clarification of the provisions regarding the payment of compensation and the possibility of accelerating accompanying investments.
The representative emphasized that he wanted the project to quickly go to the government and then to the parliament.
– The time that we have remained to issue a final location decision is no longer so long. We expect it to be the third quarter of this year. It would be very good if the law entered into force until the end of the second quarter and was signed by the president – said Lasek.
About CPK
As part of the CPK program, among others, Central airport, located between Warsaw and Łódź, and high speed rail system. The new airport is to be adapted initially to service 34 million passengers per year and designed in such a way that in the long term it can be flexibly expanded, in accordance with the needs and forecasts of market development.
According to the adopted schedule, the construction of the CPK airport in the communes of Baranów, Wiskity and Teresin is to start in 2026. In 2031, the airport is to obtain the necessary certifications, and in 2032, it is to be put into service with the first episode of KDP in Poland Warsaw – CPK – Łódź. The estimated investment cost by 2032 is PLN 131.7 billion.
