According to the draft, which is soon to be submitted to the Sejm, the employer will be able to check whether the employee is vaccinated. “The project submitted by MP Hoc treats the vaccination, test and convalescent status equally,” explained health minister Adam Niedzielski on social media.

On Twitter, the Minister of Health referred to the draft proposed by MP Czesław Hoc (PiS), according to which the employer will be able to check whether the employee is vaccinated.

“The proposed project treats vaccination, testing and convalescent status on an equal footing. This means that unvaccinated people will be able to confirm their epidemic safety with the test,” he wrote.

It was a reference to MP Hoc’s tweet regarding a bill that would allow entrepreneurs to “avoid the negative effects of the epidemic, including mass infections of employees and the need to shut down the company.”

Law and Justice deputies Czesław Hoc and Paweł Rychlik announced on Wednesday that a parliamentary bill will be sent to the Sejm allowing the employer to verify that the employee is vaccinated against COVID-19. According to the draft regulations, if an employee is not vaccinated, the entrepreneur will be able to reorganize the work, e.g. transfer such an employee to a department where he will not be in contact with customers.

The government also worked on similar regulations. – This project has been prepared in the Ministry of Health, has been consulted in inter-ministerial consultations, is to be sent to the meeting of the Council of Ministers – said Wojciech Andrusiewicz, spokesman for the health ministry, in an interview with TVN24 at the beginning of November. – In this project, on our part, a legal decision was included in which the employer may request his employee to show a covid certificate before starting work – explained Andrusiewicz.

The provisions giving such rights to employers were expected by the business community. Representatives of employers’ organizations approached the government at the end of October with an appeal to grant entrepreneurs access to information on the vaccination status of employed persons. They pointed out that such actions may prevent the introduction of further lockdowns.

When will the project go to the Sejm?

On Saturday, a government spokesman Piotr Mueller informedthat the project on the verification of vaccination of employees should be submitted “any day”. – As far as I know, this draft has already been signed in the parliamentary club, any day it should be submitted to the session of the Sejm – he said.

The next session of the Sejm, at which the deputies could deal with this project, is scheduled for 1-2 December.

When asked why the bill was not a government bill, but a parliamentary bill, Mueller replied: “We did not want to extend government work anymore, so it was submitted as a parliamentary bill.” – I hope that the opposition will also comment on this issue – he added. – Yesterday, unfortunately, there was no declaration from the largest parliamentary club whether he would support such a project or not – he stressed.
