COVID-19 – the end of the epidemic threat. Medical examinations of employees and OSH training – National Labor Inspectorate on recurring duties

From Saturday, July 1, the state of epidemic threat was canceled. Therefore, the obligations arising from the Labor Code regarding medical examinations and training in the field of occupational health and safety are returning – reminds the National Labor Inspectorate (PIP).

On July 1, 2023, the state of epidemic threat introduced in Poland in connection with SARS-CoV-2 virus infections ceased to apply. The state of epidemic emergency was introduced in Poland on May 16, 2022. Previously, the state of the COVID-19 epidemic was in force.

Obligations for employers and employees

PIP reminded that the obligations arising from the Labor Code related to periodic medical examinations of employees are returning. The employer and the employee are obliged to immediately resume the examinations suspended during the state of epidemic and the state of epidemic threat and perform them within a period not longer than 180 days from the date of cancellation of this state.

The inspection also pointed out that if, during an epidemic or a state of epidemic threat, an initial or control examination of an employee was carried out and issued a medical certificate by a doctor other than an occupational medicine doctor, then such a medical certificate expires after 180 days from 1 July this year.

In addition, all obligations arising from the Labor Code and executive acts related to conducting training in the field of occupational health and safety return.

“If the periodic OSH training period fell during the state of epidemic emergency or state of epidemic or within 30 days from July 1 this year, i.e. from the date of cancellation of the state of epidemic emergency – this period is extended to 60 days from on the day of cancellation of the state of epidemic threat, explained the National Labor Inspectorate.

Konkret24 pointed out that The end of the state of epidemic threat does not mean that all solutions from anti-covid laws will also cease to apply. Some of them will stay with us for longer, such as the COVID-19 Counteracting Fund and remote meetings of the Sejm and Senate and company authorities.
