Disciplinary proceedings have been initiated against a judge of the District Court in Krakow, Maciej Ferk, according to the statement of the disciplinary spokesman for judges of common courts, Piotr Schab. The judge was charged with committing disciplinary offenses. In September, it was reported that 11 Krakow judges refused to adjudicate in panels that would include judges elected by the new National Council of the Judiciary. One of these 11 judges is Judge Ferek.

According to information, disciplinary proceedings against judge of the District Court in Krakow Maciej Ferk were initiated on Thursday by Przemysław Radzik, deputy disciplinary spokesman for judges of common courts. The Friday announcement shows that these are three cases in which Judge Maciej Ferek was the chairman of the judges and, according to the disciplinary spokesman, violated the dignity of the office in that, by exceeding his powers, he granted himself the competence to examine the legality of the appointment of two judges of the District Court in Kraków and a judge of the Kraków Court of Appeal.

As a result – we read in the announcement – “he took unlawful actions questioning the effectiveness of the appointment and the existence of a service relationship” of these judges and “questioning the legitimacy of the constitutional organs of the Republic of Poland – the Constitutional Tribunal and the National Council of the Judiciary”.

In September, it was reported that 11 Krakow judges refused to adjudicate in panels that would include judges selected by the current National Council of the Judiciary. At the same time, they announced “taking legal measures to avoid defective judgments issued with their participation”. One of them is Judge Ferek.

At the end of October, the judge refused to give an enforcement clause to the judgment issued by the Krakow district court, which became final after the appeal was examined. The reason was supposed to be that the judges were promoted from a regional court to a court of appeal at the request of the National Council of the Judiciary elected in March 2018.

Then, the president of the District Court in Kraków, Dagmara Pawełczyk-Woicka, suspended the judge from performing official duties for a month, arguing that the judge’s behavior “violates the dignity of the Court, and also harms the good of citizens and the legal order in force in the Republic of Poland.”

At the end of October, it was also reported that after the notification to the president of the Krakow SO, explanatory actions were taken in the cases of judges of the Court in Krakow. It goes, among others for public questioning of the effectiveness of the appointment of the 1st President of the Supreme Court and the powers of the National Court Register and the Constitutional Tribunal.
