The draft amendment about the national cyber security system will go to the Sejm in June – said the deputy director of the Cyber security department at the Ministry of Digitization Marcin Wysocki. He emphasized that the change is urgent and priority.

– On Tuesday, the Committee of the Council of Ministers for National Security positively approved the draft amendment to the Act on the National Cybersecurity System – pointed out Wysocki during the Tuesday meeting of the Digitization Committee, Innovation and Modern Technologies of the Sejm of the Republic of Poland. He added that the project “as soon as possible” will go to the permanent committee of the Council of Ministers.

The next stage will be the adoption of the project by the government. – If the need arises, a legal commission may be carried out – noted Wysocki.

The government is implementing the EU Directive 2

The amendment to the UKSC is to implement the EU Directive Nis 2 on cyber security and Toolbox 5G, i.e. an EU document regarding the security of the 5G network. Wysocki reminded that on November 27, 2024. European Commission (KE) has presented formal allegations against Poland regarding the lack of implementation of NIG 2.

– On February 5, we donated the answer to formal allegations in which we indicated that parliamentary work on the project would fall for the first half of this year – said Wysocki. He added that the next step was to the EC to Poland the so -called justified opinion in connection with the notpneration of NIG 2 on time.

– The answer will be prepared by the Ministry of Digitization and transferred to the Commission until July 7, because such a deadline results from the EC letter – noted the deputy director of the Department of Digitization at MC.

Wysocki pointed out that Poland is among 19 EU countries that did not implement Nis 2 on time, and in the implementation of Toolbox 5G we are “unfortunately at the very end”, because over 20 countries have already done this.

“The project is urgent and priority”

– I am convinced that the minister of digitization and the whole government does not need to be additionally motivated. The adoption of the amendment to the UKSC is also a milestone of KPO. For these and other reasons, the project is urgent and priority – said Wysocki.

The current version of the KSC Act dates back to 2018 and there are no provisions implementing the EU Directive NIS 2 regarding cybersecurity. The deadline for implementing NIS 2 to the national legal order expired on October 18, 2024.

The Digitization Ministry presented the draft amendment to the UKC in April last year. The purpose of the latest version of the regulation is to adapt the regulations to the changing landscape of cyber threads and increase the resistance of IT systems in key sectors of the economy.

The amendment requires entities to implement more stringent risk management means and reporting security incidents. The project proposed by the ministry also provides for the procedure for recognizing the equipment supplier or software as the so -called high -risk suppliers. The Ministry of Digitization indicated that the adoption of the amendment to the KSC Act by the Council of Ministers would take place in the first quarter of this year.
