The Court of Appeal maintained a sentence of 25 years in prison for David B., who killed a 49-year-old, dealing with a hammer. Thus, the judgment is final.
The tragedy took place three years ago at the Orląt Lviv Square in Częstochowa. On June 24, 2022, Dawid B. and Jordan M. stayed in a friend's apartment and drank alcohol. Dawid B. called his partner several times, who in the company of other people was at the Square of the Lviv Eaglets. Talking to his partner, Dawid B. told her to return home and threatened that if he did not listen to him, he would come and hurt someone.
The 49-year-old hit the head and neck several times
When B. and M. arrived, they went to the bench where B.'s concubine sat in the company of other people. Dawid B., holding a hammer, began to fuss. At one point, he hit one of the men with a hammer on the head and neck several times. The attacked 49-year-old died as a result of serious head injuries.
Both attackers were detained on the same day. During the investigation, the prosecutor charged Dawid B.. The man was arrested. He has been punished many times before. Jordan M., suspected of participating in beating with a fatal outcome, after leaving the prison, he was hidden from law enforcement agencies, he was prosecuted by arrest warrant and a European arrest warrant. He was detained in Potsdam and handed over to Polish law enforcement agencies. He corresponds to a separate trial on the District Court in Częstochowa.
25 years in prison for murder
The indictment against B. District Prosecutor's Office Częstochowa-Południe sent to the District Court in Częstochowa in June 2023. The prosecutor accused him of the murder of a 49-year-old man, directing criminal threats against a partner and other people, as well as violation of bodily inviolability and destruction of property.
In November 2024, the Częstochowa court sentenced the accused to a total penalty of 25 years imprisonment. In addition, he said that Dawid B. would have to pay 40 thousand. PLN compensation for the victim's wife.
The judgment was appealed by the prosecutor, who demanded life imprisonment, as well as by the defender. The Court of Appeal in Katowice upheld the judgment of the Court of First Instance – a spokesman for the District Prosecutor's Office in Częstochowa said Tomasz Ozimek on Tuesday.
