The 66-year-old taxi driver stopped in the bike lane and was helping a passenger to take out his luggage. A 33-year-old professional driver passed him in his car, driving too fast and having a blood alcohol level of 3.4 per mille. The 66-year-old died on the spot, the 33-year-old left the car and disappeared for half an hour. The indictment was filed with the court.

The District Prosecutor’s Office of Częstochowa-Południe filed an indictment against 33-year-old Łukasz P. to the District Court in Częstochowa.

The prosecutor charged him with causing death while intoxicated traffic accident and fleeing the scene. – Interrogated as a suspect, Łukasz P. confessed to the alleged crime, but explained that he did not flee the scene – Tomasz Ozimek, spokesman for the District Prosecutor’s Office in Częstochowa, said in a statement.

The first hearing is scheduled for July 11. P. will not respond freely. Due to the high penalty he faces, he has been in custody since the accident.

On December 26, 2022 in Częstochowa, around 5 pm, 33-year-old Łukasz P. was driving a passenger Peugeot along Bohaterów Katynia Street towards Rakowska Street. At the same time in the bicycle lane a taxi stopped, whose 66-year-old driver was helping a passenger to remove his luggage from the vehicle.

According to the investigators, while avoiding a taxi, Łukasz P. hit a 66-year-old taxi driver, who died at the scene as a result of multiple injuries. “Łukasz P. left the car and walked away on foot, but was stopped by the police after about 30 minutes,” the prosecutor’s office reads.

Based on the tests carried out, it was established that at the time of the accident Łukasz P. had about 3.4 per mille of alcohol in his body.

The road traffic expert appointed in the case concluded that the cause of the road accident was Łukasz P.’s failure to exercise due caution when performing the evasive maneuver, and in particular the safe distance from the vehicle being avoided. In addition, the expert calculated that the driver was traveling at a speed of 71 kilometers per hour, at a speed limit of 50 kilometers per hour.

P. is a driver by profession and has no criminal record in the past.

As Tomasz Ozimek explains, the crime of causing a road accident, which results in the death of a person or serious damage to health, if the perpetrator was intoxicated or under the influence of drugs or fled the scene, is punishable by imprisonment from two to 12 years. In this case, the court also orders a lifetime ban on driving any motor vehicles.
