Public offices, local governments, schools and hospitals will be required to provide details of the contracts concluded, writes “Rzeczpospolita”. According to the MP’s amendment to the Penal Code, from July 2022, information on employment contracts concluded with their employees will be published in special electronic registers kept by all public finance units.

According to Rzeczpospolita, the proposed regulations, which are to be a tool to counteract corruption, went a step too far.

“Everything indicates that the parliamentary amendment to the penal code, adopted by the Sejm in mid-October, which is only waiting for publication in the Journal of Laws, may constitute a revolution for over a million officials and employees of public and local administration, employees of the Social Insurance Institution, tax office, employees in education and medical care. And maybe also prosecutors, judges and uniformed officers “- we read in the journal.

The newspaper asked the Ministry of the Interior and Administration and the Chancellery of the Prime Minister which entities were concerned. “In response, we only heard that the draft providing for the introduction of these registers as a deputy was not consulted with the government” – it was written.

“The amendment shows that the Public Finance Act will include a new Article 34a, according to which the electronic register is to contain data on all contracts concluded by a given public finance unit. administration, education and health service “- explains the daily.

Data on salaries on the Internet

“Rzeczpospolita” writes that “all data that may be disclosed under the Act on access to public information are to be published”. He adds, however, that “the problem is that this provision is so widely understood by the courts that it applies not only to officials issuing administrative decisions, but also, for example, to teachers”.

– The register of contracts was planned mainly for civil law contracts concluded by public finance units. The fact that, according to the final version of the amendment, will also include employment contracts is a fact, noted Mirosław Wróblewski, director of the constitutional, international and European law team at the Human Rights Defender’s Office, quoted by Rzeczpospolita.

“Revolution in open wages”

– The law was passed in order to prevent corruption. The obligation to publish contracts of all employees of the public finance sector goes much further, says Wojciech Klicki from the Panoptykon Foundation in an interview with the daily. He also adds: – I have the impression that a real revolution in disclosure of remuneration has been quietly introduced. Perhaps it will help fight the wage inequality, but I am not sure that our society is ready for this.

– The new regulations should also be assessed in terms of their compliance with the GDPR – says Jan Prasałek, an attorney from RK Legal, quoted by Rzeczpospolita. He adds: – The question arises as to what specific scope of data will be made public. If it is too broad and includes, for example, the PESEL number or the address of residence, in addition to the name and surname, officials will have legitimate objections to the protection of their privacy and property rights. In such situations, they may submit a complaint to the President of the Personal Data Protection Office.
