The single-member Constitutional Tribunal issued an interim decision suspending the validity of the decision of the Minister of Justice to suspend Piotr Schab from performing the duties of the president of the Court of Appeal in Warsaw. An MP from the Civic Coalition, Roman Giertych, asked for a piece of paper in the studio and pretended to write: “Attorney Roman Giertych has decided that Bogdan Święczkowski and other judges of the Constitutional Tribunal have no right to issue any decisions.” – It has the same value as what Mr. Święczkowski wrote – he said.
Ministry of Justice announced the initiation on January 18 procedures for dismissing Piotr Schab, president of the Court of Appeal in Warsaw. At the same time, Judge Schab was suspended from performing his duties. The Ministry of Justice argued that “Judge Piotr Schab repeatedly abused his power – both while performing administrative functions in the justice system and as a disciplinary spokesman.”
Thursday Constitutional Court Julia Przyłębska issued an interim decision suspending the validity of the decision of the Minister of Justice regarding the suspension of Piotr Schab from the duties of the president of the Court of Appeal in Warsaw.
The Constitutional Tribunal’s decision was made by a single-member bench – judge Bogdan Święczkowski. He was elected to the Constitutional Tribunal in 2022. Previously, he served, among others, as a national prosecutor. He was considered a close associate of the then Minister of Justice and Prosecutor General Zbigniew Ziobro. In 2010, Święczkowski was elected as a councilor of the Silesian provincial assembly, and in elections In 2011, he obtained a parliamentary mandate from the list PIS.
Giertych asked for a card. “It has the same value as what Mr. Święczkowski wrote”
When asked how the decision of the Constitutional Tribunal could be interpreted, Giertych asked the program’s host, Piotr Kraśka, for a piece of paper. The guest of “Fakty po Faktach”, imitating writing movements, said: – Patron Roman Giertych decided that Bogdan Święczkowski and other judges of the Constitutional Tribunal have no right to issue any decisions.
– It has the same value as what Mr. Święczkowski wrote – said Giertych. – These people sitting there came to the Constitutional Tribunal when the Sejm dismissed the properly elected judges of the Tribunal – said the MP.
Giertych assessed that the Tribunal acted exceptionally quickly. – They interfere in every matter of state life. Regarding the laws that can unlock money from the KPO, we have been waiting for months for any decision, and here they act within a few days. Mr. Święczkowski is making fun of the Constitutional Tribunal, which once had a reputation and authority. There were outstanding professors there, (…) and now we are dealing with the actions of people who simply make a mockery of the law, the constitution and the Republic of Poland – said Giertych.
