Piotr Kraśka’s guest in Thursday’s edition of “Fakty po Faktach” on TVN24 was Deputy Minister of Justice Zuzanna Rudzińska-Bluszcz, who was asked about the situation of legally convicted prisoners. Mariusz Kamiński and Maciej Wąsik.

Last Thursday, the president Andrzej Duda decided to initiate pardon proceedings against PiS politicians. He also turned to the Minister of Justice and the Prosecutor General Adam Bodnarto suspend the execution of the sentence and release them from custody for the duration of the pardon proceedings. – The law is clear. Mr. Wąsik and Mr. Kamiński ceased to be MPs on the day the final judgment was issued on December 20, 2023 – recalled Rudzińska-Bluszcz.

When asked at what stage the pardon procedure was, the deputy minister replied that “there are several dozen files on the desk of the prosecutor general and the minister of justice, including several volumes of classified files in a criminal case.” – Now the prosecutor general is analyzing these files to issue a position and send it together with the files to the president – she explained. She emphasized that “these are several dozen volumes of files.”

– We in the ministry are aware of how urgent this issue is. The Attorney General is analyzing these files. Of course, not all files require reading from cover to cover, but in the shortest possible time this position will be issued and attached to the files and forwarded to the president, she said.

When asked when this would happen, Rudzińska-Bluszcz warned that this issue was within the competence of the prosecutor general. – So I can’t even answer that question. I think it will be as soon as possible. Rather in weeks than in months, she said.

The deputy minister was also asked about the summary of earnings of the former national prosecutor and deputy prosecutors general, made available by prosecutor Ewa Wrzosek, who – apart from Robert Hernand – were appointed by Zbigniew Ziobro. The information shows, among other things, that former national prosecutor Dariusz Barski earned nearly PLN 1 million gross in less than two years.

– Indeed, these amounts were surprising to me, I would even say shocking, and even more shocking when compared to the earnings of district prosecutors, where 99 percent of investigations are conducted. These are earnings of at most PLN 16,000 gross per month, she admitted.

She recalled that “the vast majority of investigations into cases involving ordinary citizens are conducted at the lowest levels of the prosecutor’s office.” – And these prosecutors do most of the work for citizens – she noted.

“We have started an internal audit of the Justice Fund.” Two teams will be formed

During the conversation, questions were also asked about the spending of funds from the Justice Fund by the United Right government.

According to data from the Ministry of Justice, almost 130 organizations received a total of over PLN 216 million from the fund over seven years. In turn, another list from the ministry shows that in the last two years alone, almost PLN 140 million was paid from the Justice Fund to 40 organizations to create the Victims’ Assistance Network.

– This information is equally shocking, or perhaps even more so. Let’s remember that these are public funds. These are funds from the Justice Fund, which is a special purpose fund established to serve people in very difficult situations: victims of crimes, witnesses of crimes, people who leave prisons as part of post-penitentiary assistance – explained the deputy minister.

Meanwhile, as she recalled, both journalistic investigations and reports show that NIK, “it seems that these public funds, our money, have been spent, at least in part, on completely different purposes.” – We have been at the Ministry of Justice for a month. What we need to do is first of all assess the current state of the fund in general and then start a thorough audit. And we are at this stage right now. We have started an internal audit of the Justice Fund, said Rudzińska-Bluszcz.

She emphasized that there are 120 entities subsidized from the fund, “in terms of payments in January this year.” – These payments have been suspended. Now they are subjected to thorough inspection. I hope that when this audit is over, some of the funds will be able to be paid to entities that, as I said, serve people and serve citizens. We will continue to consider what to do with entities that either spent these funds improperly or perhaps committed crimes in spending these public funds, she continued.

She said that for this purpose, the Ministry of Justice wants to appoint “a team of prosecutors who will assess the actions and behavior of the responsible persons, whether they exceeded their powers, failed to fulfill their duties, whether public finance discipline was violated.”

– On the other hand, we also want to establish a social team regarding the Justice Fund, which will consider how this fund should be organized in the future so that it meets its goals, how competitions and offers are to be announced, how committees to evaluate these offers are to be appointed, what principles of transparency should be adopted so that this fund serves all of us, citizens and, above all, people in need, which was established for this purpose in 2012 – explained the deputy minister.

Rudzińska-Bluszcz also commented on the information about the initiation by the Ministry of Justice procedures for dismissing judge Piotr Schab from the position of president of the Court of Appeal in Warsaw. – The good of justice requires that (the procedure) end with an appeal – she said. She added that Schab “exceeded his authority, both as a disciplinary spokesman and as president of the Court of Appeal in Warsaw.” – Moreover, in our opinion, in accordance with European Union law, a high administrative function in court should not be combined with the function of a disciplinary spokesman – she noted.
