Disciplinary Chamber of the Supreme Court. Judge Włodzimierz Wróbel on what to do next with its functioning

Professor Włodzimierz Wróbel, judge of the Criminal Chamber, spoke about the functioning of the unrecognized Disciplinary Chamber of the Supreme Court in “Fakty po Faktach”. He judged that “the files of cases that are currently in the Disciplinary Chamber, and partly also in the Extraordinary Audit and Public Affairs Chamber, should be transferred to the Criminal Chamber or other chambers of the Supreme Court and should be pending”.

On Thursday, two ordinances of Małgorzata Manowska were published on the website of the Supreme Court, in which the first president of the Supreme Court partially frozen the work of the Disciplinary Chamber in question. On Friday, Manowska was criticized by the Minister of Justice Zbigniew Ziobro, who believes that the judgments of the Court of Justice of the European Union in the case of the Disciplinary Chamber should not be implemented.

The President of Law and Justice, Deputy Prime Minister Jarosław Kaczyński announced on Saturday in an interview with the Polish Press Agency that the Disciplinary Chamber in question in the form in which it currently operates will be liquidated and thus “the subject of the dispute will disappear”. He added that the first proposals on this matter would appear in September.

The judge of the Criminal Chamber of the Supreme Court, Professor Włodzimierz Wróbel, when asked what our situation is now, said that the legal side of this situation was clear. – Files of cases that are currently in the Disciplinary Chamber, and partly also in the Extraordinary Control and Public Affairs Chamber (…) should be transferred to the Criminal Chamber or other chambers of the Supreme Court and proceedings should be pending, rulings should be issued – he spoke.

Judge Wróbel said that if he were a vacationer watching from the sidelines and listening to what was happening, he would have thought that “we are in the frog-eating phase, in the phase of some other soap opera episode, sad at the prospect of being real and not just some Mexican or Turkish series. ”

“I don’t know what the politicians will do with all of this,” he added.

When asked if Manowska’s decision was the implementation of the CJEU judgment, a judge of the Supreme Court said that “he does not want to step into the shoes of an authority such as the CJEU or the Commission (European-ed.)”. – But it is certainly in some sense the execution of these judgments. That at least the files will not go there – he assessed. – However, the situation when this Chamber is still operating is not an enforcement of these judgments, there are cases that have not been frozen – he added.
