Dispute in the Constitutional Tribunal. The General Assembly of Judges issued a resolution on the term of office of Julia Przyłębska

A spokeswoman for the Constitutional Tribunal reported that the General Assembly of Constitutional Tribunal Judges adopted a resolution on Wednesday stating that there were no grounds for convening an assembly to select candidates for the President of the Tribunal. Earlier, six judges of the Constitutional Tribunal sent a letter in which they demanded the selection of candidates, arguing that the term of office of Julia Przyłębska had expired.

It is in the Constitutional Court conflict over the term of office of president Julia Przyłębska. At the end of 2022, some lawyers, including former judges of the Constitutional Tribunal, indicated that the term of office of President Julia Przyłębska expires after six years, i.e. on December 20, 2022, and that she will not be able to apply for this function again.

At the beginning of January, six current judges of the Constitutional Tribunal sent a letter to Julia Przyłębska and to the president Andrzej Dudain which they demanded the convening of the General Assembly of the judges of the Constitutional Tribunal and the selection of candidates from among whom the president would nominate a new president. The authors of the letter expressed their belief that, pursuant to the Act on the organization and procedure before the Constitutional Tribunal, the term of office of the current president had come to an end.

As “Rzeczpospolita” reported, on Tuesday, in another letter, the request of six judges was repeated.

There is a resolution on the term of office of Julia Przyłębska

On Wednesday evening, the spokeswoman for the Constitutional Tribunal, Aleksandra Wójcik, announced that the General Assembly of the Judges of the Constitutional Tribunal, convened by Julia Przyłębska, had been held earlier that day.

– The subject of the meeting was the letter of six judges of the Constitutional Tribunal of February 28 this year, in which it was once again requested to convene the General Assembly of the Judges of the Tribunal in order to select candidates for the position of the President of the Constitutional Tribunal – informed Wójcik.

She added that the Assembly “by an absolute majority of votes, in the presence of 2/3 of the total number of judges of the Constitutional Tribunal, adopted a resolution in which, referring to the letter of the judges of the Constitutional Tribunal, it was stated that there are no legal and factual grounds for convening the General Assembly of Judges of the Constitutional Tribunal pursuant to Article 11(3) of the Act of 30 November 2016 on the organization and procedure before the Constitutional Tribunal” for the purpose of selecting candidates for the position of the President of the Constitutional Tribunal.

Already at the beginning of January – in response to the first letter of the six judges of the Constitutional Tribunal – Przyłębska declared that her function as president would expire at the end of her term of office as a judge of the Constitutional Tribunal. According to her, the letter of the six judges had no basis in law and was pointless.
