Donald Tusk on Adam Glapiński. Investigation into the PO leader’s words about the NBP president

Did Donald Tusk, the leader of the Civic Platform, intend to remove the president of the National Bank of Poland by force? The investigation in this case has been conducted by the District Prosecutor’s Office in Radom since September. Prosecutors are also investigating whether Tusk “with an unlawful threat” influenced the “official activities” of the head of the NBP and whether he insulted him. If the Prosecutor’s Office in Radom indicts the leader of the opposition and the case goes to court, Tusk may face up to 10 years in prison.

He accused the President of the National Bank of Poland, Adam Glapiński, of incompetence and inability to predict, recalling his statements from two years ago about deflation as a threat and “alleged threat of explosion inflation“. The leader of the PO then announced that if PO wins the election, he will “take Glapiński out of the NBP”. – Adam Glapiński is not only incompetent, not only indecent in what he does. Adam Glapiński is also illegal. He will not be president for a day longer NBP. There will be no need for an act – said Tusk in Radom at the July convention.

We have learned that the Prosecutor’s Office in Radom suspects that Tusk may have committed a crime under the provisions of the Penal Code, which may rarely apply, for example against terrorists planning to overthrow the government by force. It is about Article 128 of the Penal Code, which speaks of “an attack on the constitutional organs of the state”. We asked the Prosecutor’s Office in Radom what was the basis for conducting such an investigation into the statement of the PO leader.

“Removal by force”

Prosecutor Agnieszka Borkowska, spokeswoman for the District Prosecutor’s Office in Radom, told us that such an investigation was in fact initiated. And prosecutors suspect in it that Tusk could have committed two crimes.

The first thread is about “preparing (…) actions directly aimed at removing by force the constitutional body of the Republic of Poland – the President of the National Bank of Poland”. And also for “exerting an unlawful threat on his official activities by publicly formulating statements questioning the legality of the appointment of Adam Glapiński for the second term of office of the President of the National Bank of Poland and announcing that he will immediately be deprived of his function if a political party wins civil Platform parliamentary elections.”

“From one year to 10 years”

In this case, prosecutors suspect that Donald Tusk could have committed a crime under all three paragraphs of Article 128 of the Penal Code, which refers to “an attack on the constitutional organs of the state”. What exactly are the provisions of the prosecutor’s office referring to?

§ 1 Whoever, in order to remove by force a constitutional body of the Republic of Poland, undertakes activities aimed directly at the achievement of this goal, shall be punishable by imprisonment for a period of not less than 3 years. imprisonment from 3 months to 5 years. § 3. Who by violence or unlawful threat affects the official activities of the constitutional body of the Republic of Poland, shall be punishable by imprisonment from one year to 10 years.

“Insult and humiliation up to 2 years”

The second crime committed by Tusk during the July convention of the Civic Platform is assumed by the Radom prosecutors is “public insult and humiliation of (…) the constitutional body of the Republic of Poland by publicly formulating statements undermining the competence of Adam Glapiński to perform the function of President of the National Bank of Poland and the legality of his choice, i.e. for an act under Article 226 § 3 of the Penal Code”. This provision says that “whoever publicly insults or humiliates a constitutional body of the Republic of Poland is subject to a fine, the penalty of restriction of liberty or imprisonment for up to 2 years”.

Prosecutor Borkowska adds that the investigation was initiated on September 30, 2022. The reason was NBP notification of July. – Donald Tusk, and then Tomasz Siemoniak they were kind to say that the next day after they win the elections, they will remove the NBP president from the seat – said the head of the NBP. – I would be afraid if Poland entered such a period of its history that “strong people” would lead state officials out of all institutions that they do not like. I hope that doesn’t happen. We live in a democratic country in the 21st century in Europe and it cannot be like this, said Adam Glapiński in July.

– The proceedings are in phase in rem (in the case – ed.), in the course of it, no charges were presented to any persons – added the spokeswoman of the Radom prosecutor’s office.

The District Prosecutor’s Office in Warsaw is conducting a separate investigation into Siemoniak’s statements. We do not know how the capital’s prosecutors evaluate this case.
