The Civic Coalition will submit its project, which gives the right to safe abortion up to the 12th week – announced Donald Tusk in the first interview after taking the oath of his government. He assured that changes are also ready that will enable access, without a prescription, to the so-called “morning after” pill.

When asked whether the project could be supported by the parliamentary majority, he replied that he could not speak for other politicians. – Hołownia and Kosiniak-Kamysz did not hide that they had a different view on this matter and they received their 15 percent of votes. Everyone who voted for Polish People’s Party or Poland 2050, he could have no doubt that on the issue of abortion they were supporters of the so-called compromise and later a referendum – he said.

– Nobody had any doubts that in the case of the Civic Coalition, the project would concern legal and safe abortion up to the 12th week. I did not convince Marshal Hołownia and Prime Minister Kosiniak-Kamysz to accept the project of legal abortion until the 12th week, so we will try to pass it in the Sejm – explained the Prime Minister Donald Tusk.

– If a bill is not possible because we do not win a majority of votes, we will look for ways to implement it through regulations, administrative decisions, persuasion and certain policies conducted by the Ministry of Health and national consultants – he announced.

He admitted that without the support of the Third Way, the project would most likely not gain the support of a majority in the Sejm. – Currently, we are working primarily to ensure that, regardless of progress or lack of progress in the laws, the practice of procedures in Polish hospitals will radically change. This means that doctors should be fully aware that they are responsible for the woman’s safety, he said.

– To put it simply, there was often an argument that doctors did not decide to terminate the pregnancy to save the woman’s life. We are talking about a different case than abortion up to the 12th week, but it aroused so many emotions and unjustified deaths of women who could not wait for the termination of the pregnancy at the risk of their lives. Since Ziobro’s time, we have simply been afraid of the prosecutor’s office, so the situation will change 180 degrees, announced the Prime Minister.

– What should really worry is those who refuse to help a woman in such a situation. If a doctor refuses to provide life-saving treatment to a woman, it is a problem for the law, not the other way around, he added.

“If it turns out that the only way to liberalize abortion law is through a referendum, we will come back with this question.”

The Prime Minister said that if there is no other solution to liberalize abortion law, discussions will be held about holding a referendum on this matter. He stressed that he was against such a solution, and women should be asked about these issues.

– If it turns out that the only way to liberalize abortion law is through a referendum, we will come back with the question of whether we should do it or not. But we have to ask women about this, of course, he said.

Access to the morning-after pill

Tusk said that a project is ready that will enable access, without a prescription, to the so-called morning-after pill. – What we really want is to delete one sentence in the bill, but unexpectedly this project has become ideological for some. The act specifically includes those and only those drugs that are legally indicated and require a prescription, which means that in many places in Poland they are completely unavailable, and it is known that time plays a role here.

– The inability to obtain a prescription means that this form is inaccessible to many women, so I will not give up here either – assured the Prime Minister.

Abortion is legal in two cases

Under current regulations, abortion is legal in two cases: pregnancy resulting from rape and when the woman’s life or health is at risk. The third condition for the legality of abortion – when prenatal tests indicated a high probability of serious and irreversible damage to the fetus – was found unconstitutional by Constitutional Court in October 2020. In November last year, at the very beginning of the new term, two projects from the Left regarding the liberalization of abortion regulations were submitted to the Sejm. One of them partially decriminalizes abortion and assistance in it, the other allows termination of pregnancy until the end of the 12th week of its duration.
