I think that we will get to know the bill enabling paid work without losing benefits in the coming weeks – said on Wednesday Deputy Minister of Family and Social Policy, Government Plenipotentiary for the Disabled, Paweł Wdówik. When asked what criterion will be used and whether there will be a threshold for possible earnings, he said that “at the moment there are different variants on the table – threshold and slider”.

Wdówik told RMF FM that the ministry is working on the implementation of the Convention on the Rights of Persons with Disabilities. At the request of the head of the Ministry of Labor and Social Policy, Marlena Maląg, “solutions are also proposed that (…) will also include assistance for people with disabilities, at a time when parents are, for example, at work”. “We’re doing that right now,” he said.

Jurisprudence is an obstacle

In his opinion, “the case law stands in the way.” – And the fact that in the system the definition of a guardian is not a practical definition, it is a legal definition that indicates what is the relationship between a disabled person and a member of their family or legal guardian for children without parents. – This means that each person remaining in such a relationship, who is now on the labor market, could immediately apply for this benefit – added the government plenipotentiary for disabled people. When asked when a specific bill would see the light of day, Wdówik said “in the coming weeks”. When asked what criterion will be used and whether there will be a threshold for possible earnings, he said that “at the moment there are different variants on the table – threshold and slider”.

When asked when the government intends to implement the judgment of the Constitutional Tribunal equalizing benefits for carers of disabled people. Wdówik stated that he had been waiting for this verdict for 8 years. – This is an element that we are trying to include in the system related to the care benefit. We are analyzing the possibility of executing this sentence, he said.
