The head of the National Electoral Commission, Judge Sylwester Marciniak, set the date of the National Electoral Commission meeting for Monday, October 28. Its members will discuss the party's reports for 2023, but it is not certain that final decisions will be made regarding the largest groups, including Law and Justice.

Marciniak said that “it is difficult to predict” whether the National Electoral Commission will consider the report on October 28 PIS. – Work is still ongoing, there are two weeks left until the meeting. We need to prepare draft resolutions, analyze reports and expert opinions, he said.

– We still have to adopt a lot of resolutions regarding the financial reports of committees from the elections to the Sejm and Senate. In addition, there are reports of political parties for last year – there are nearly 100 parties, and we have adopted 10 reports so far – said the head of the National Electoral Commission.

He did not want to prejudge the future fate of the PiS report from 2023. The Commission's decision in this matter depends on the Supreme Court's decision on PiS's complaint against the National Electoral Commission's decision to reject the committee's report on the parliamentary elections.

Dispute over the status of one of the chambers of the Supreme Court

The problem is that the status of the Chamber of Extraordinary Control and Public Affairs of the Supreme Court – which is competent to consider the PiS complaint – is questioned by the current government, as well as some members of the National Electoral Commission.

– There will definitely be a solution, and most of it. I cannot imagine that we would not hold the elections that are fast approaching, said the head of the Commission.

He reminded that at the beginning of February at the latest, the Marshal of the Sejm must issue a decision setting the date of the presidential elections, and then the National Electoral Commission will accept notifications of the establishment of electoral committees and register candidates.

– We have to adopt several dozen resolutions regarding the conduct of elections and it should be noted that electoral committees will have the right to complain about the resolutions of the National Electoral Commission to the Supreme Court. There are strict deadlines, two days to submit a complaint and two days to consider the complaint. I cannot imagine a situation where by then – if we want to hold elections – the issue of who will consider complaints will not be resolved – he emphasized.

Marciniak: it's a huge burden

He also pointed out that the National Electoral Commission has never had such problems with accepting or rejecting financial reports as now. – In history, there have never been so many different controversial issues, not only legally, but also economically. This is a huge burden. This is combined with the voices of politicians who want to pursue their own political activities at the expense of the electoral authorities. This is not an easy situation, he emphasized.

Marciniak also emphasized that he is in favor of detailed control of the financing of parties and election campaigns, but first the Commission must be given legal instruments for such control.
