The District Court in Ełk (Warmian-Masurian Voivodeship) conditionally discontinued the proceedings in the case of the father who chained his 12-year-old daughter to the floor. Such a decision was requested by the prosecutor’s office, which found that the girl did not go to school and ran away from home. And when my father heard him talking on the phone with his friend about another escape, he decided to take this – as the head of the district prosecutor’s office in Ełk says – a desperate step.
On Thursday, March 18, the police entered one of the apartments in Ełk, where they found a 12-year-old chained to the floor. The officers were summoned by the girl’s friend, who was contacted via the Internet.
As in March, in an interview with tvn24.pl, the spokesman of the District Prosecutor’s Office in Suwałki (she supervised the proceedings conducted by the District Prosecutor’s Office in Ełk) Wojciech Piktel, a teenager chained to the floor was under the care of his 37-year-old father and his concubine, who was a year younger.
The father looked after three daughters aged 8, 12 and 15
– The couple raised two more children, aged eight and fifteen. It was established that there were no acts of violence against these two. The mother of all three is abroad, the prosecutor said.
All three girls were temporarily placed in a foster family, while both the father and his partner heard accusations of depriving the 12-year-old of freedom and of causing minor injuries to her body.
Prosecutor’s office: the event was of a one-off nature
After almost eight months from the incident, the District Court in Ełk decided to conditionally discontinue the proceedings in this case, appointing the so-called a trial period that will last two years. Such a decision was requested by the District Prosecutor’s Office in Ełk.
– After careful examination of the circumstances, it turned out that the event which occurred was of a one-off nature. The father was unable to cope with his daughter, who caused educational difficulties. She did not go to school and ran away from home. She came back after a few days – says Jan Mikucki, head of the aforementioned prosecutor’s office.
There is no evidence of prior physical or psychological abuse
When the father heard his daughter talking to her friend on the phone about another escape, he decided – as the prosecutor reported – to take a desperate step.
He took the chain and tied one end around the girl’s leg. He nailed the other end to the floor. The 12-year-old was imprisoned in this way overnight, says Jan Mikucki.

Although he admits that it is difficult to approve such an educational method, the proceedings conducted did not provide any evidence that the father had previously committed physical or mental violence against his daughter.
– Noticed slight abrasions of the epidermis around the ankle caused by the fact that the 12-year-old tried to free herself. As for the concubine, however, according to her explanations, she was against chaining the girl to the floor. However, she concluded that the decision was up to the cohabitant. They both expressed their regret and declared that in the future they would never resort to such educational methods anymore – emphasizes our interlocutor.
The prosecutor’s office also obtained the opinion of the school attended by the daughters. The reviews show that the children are not neglected and that the father and his concubine are interested in their academic performance.
The court limited my father’s parental responsibility
The court, conditionally discontinuing the proceedings, limited the father’s parental responsibility. – The exercise of this authority is to be supervised by a probation officer. If the latter decides so, the children will no longer be placed in a foster family, says the prosecutor.
The girls’ mother is abroad.
