As announced by Metsola, all applications have been referred to the European Parliament's Legal Affairs Committee (JURI) for consideration.
According to the procedures, applications must now be submitted assessed at the meeting JURI in terms of form and – if necessary – supplemented with missing documents. A rapporteur will be appointed for each case.
Troubles for four PiS MEPs. The procedure in the EP has begun
According to EU sources, there is a possibility that the rapporteurs will be selected next week. Everything will depend on whether Ursula von der Leyen will be able to present the full list of candidates for commissioners on time – Tuesday morning. If so, JURI will first have to focus on verifying the candidates for commissioners, including assessing the compliance of their asset declarations, and only then will it be able to deal with immunity issues.
In the next step, the MEPs concerned by the proposals will be asked by the committee to providing explanations. This, after a debate taking into account the evidence and explanations of the Members of Parliament, will prepare a draft report with a recommendation and submit it to the President of the European Parliament. The whole will end plenary vote during one of the sessions of the Parliament, where the EP will vote on lifting of immunities. The decision will then be publicly announced and communicated to interested parties.
Motion to waive immunities Wąsik and Kamiński was submitted to the EP at the end of July. The prosecutor's office accused them failure to comply with a final judgment prohibiting the performance of public functions. Motion regarding Dworczyk It was sent to the head of the European Parliament at the end of August and is associated with allegations of a politician's involvement in the so-called email scandal. Application for Adam Bielan It was submitted to the EP last week; it concerns irregularities related to the spending of money within the National Centre for Research and Development.
The Case of Mariusz Kamiński and Maciej Wąsik. “It's Revenge”
Mariusz Kamiński and Maciej Wąsik deny the charges, claiming that their cases are politicized. In April District Prosecutor's Office in Warsaw brought charges against Wąsik and Kamiński related to their participation in the vote in the Sejm on December 21. The day before, both politicians were legally sentenced to two years in prison for participating in the so-called land scandal. The court also imposed a five-year ban on performing public functions on them – and therefore on their mandate as members of parliament, which they also lost as a result of their conviction.
Kamiński and Wąsik are of the opinion that President Andrzej Duda pardoned them, so they are still members of parliament. In February, however, the prosecutor's office launched an investigation into Kamiński and Wąsik's failure to comply with the ban on holding public offices. In April, they were charged with failing to comply with the imposed penal measures, which is punishable by three months to five years in prison.
– I did not accept the prosecutor's allegations. I believe that my mandate has not expired, i.e. I am a member of parliament, and it was not possible to make allegations – said Wąsik in a conversation with the media. – The investigations around me are politically motivated. I will only recall the statement of Donald Tusk, who at one point announced: this is not the end of the Wąsik and Kamiński case. In other words, he gave the signal to the services to pursue us. This revenge – he added.
Motion to lift Michał Dworczyk's immunity. “Another political attack”
Motion to waive immunity To Michał Dworczyk – former head of Prime Minister Mateusz Morawiecki's office – concerns the email scandal. According to investigators, Dworczyk may have committed two crimes, including failure to fulfil obligations, consisting in using a private email box without appropriate security measures to conduct business correspondence.
According to the prosecutor's office, the correspondence that was intercepted by hackers due to the politician's negligence included: classified information concerning defense and secret serviceseconomy or international relations. The second charge that the prosecutor's office wants to bring against the politician, refers to obstructing the investigationAfter the scandal was revealed, politicians he was supposed to have ordered the contents of his mailbox to be deletedwhich results in loss of evidence of a crime.
– I treat this as another political attack. The first time information that such a motion was to be submitted to the Polish Sejm appeared on the eve of the election silence in the elections in which I was a candidate for the European Parliament. Suddenly, it turned out that in the investigation that had been ongoing for over 3 years, my status was to change from a wronged person to a suspect – said the former head of the Chancellery of the Prime Minister in an interview with RMF FM.
