Korneluk, a prosecutor from the Lex Super Omnia Prosecutors’ Association, was a guest on Thursday in the “Tak jest” program on TVN24, where he talked with attorney Michał Wawrykiewicz from “Free Courts” about the process of restoring the rule of law, including in the prosecutor’s office.

– Recent years many times Court of Justice of the European Union he had a lot to say against Poland in the context of the rule of law. Today, in my opinion, we see how the rule of law in Poland is being restored in small steps, but consistently. And this – as you can see, (…) is not liked by known people who contributed greatly to this illegality in Poland – said Korneluk.

– Referring to the prosecutor’s office, it must be said directly – what was supposed to be concreted for years, or at least for two years, turned out to be very fragile. Today we see that it was mediocre lawyers who concreted the prosecutor, he continued.

He stated that this “concreting was not effective enough, because today we see (that) there are already new regional prosecutors, there are new district prosecutors.” He added that “the investigations that were blocked are slowly starting to take place.” – The prosecutor’s office is starting to be law-abiding, but most importantly – the prosecutor’s office will slowly be consistently removed from the label of being politicized – said the candidate for the position of national prosecutor.

Korneluk: Minister Bodnar went towards the competition in order to depoliticize the prosecutor’s office as much as possible

Dariusz Korneluk also talked about the competition to select the national prosecutor. The candidates will be assessed by a team led by Deputy Minister of Justice Maria Ejchart.

The TVN24 guest pointed out that there is no provision directly mentioning a competition for a candidate for national prosecutor. – However, the Minister of Justice and the Prosecutor General assumed that he would not act alone choice. Because there is nothing to hide, the Minister of Justice is a politician and in order to depoliticize the prosecutor’s office as much as possible, depoliticize the future national prosecutor, Minister Bodnar went for the competition – Korneluk continued. He added that investigators should be expected to return to matters that were inconvenient for the previous government.

Wawrykiewicz: the current prosecutor’s office is heading in the right direction

Michał Wawrykiewicz also said that the competition to select the future national prosecutor is a “good idea”. – Because it makes the choice of the national prosecutor more transparent. There is substantive verification and the candidates who have to take part in this competition have a much harder time than it would be if it was chosen by one person – he emphasized.

– I feel positive about this because I would like the national prosecutor not to be – as in previous years – a political appointee, but to meet the highest standards, both moral, substantive and professional – added the lawyer.

– I am convinced that the current prosecutor’s office is heading in the direction in which the prosecutor’s office should be heading, i.e. it should fulfill the function of a public prosecutor. After all, this is a body that is supposed to safeguard the rule of law and protect us against criminals. All of us, regardless of whether these criminals come from the opposition, the government or anyone else. And I expect such a prosecutor’s office in the coming years, emphasized Michał Wawrykiewicz.
