Free contraception for women up to 25 years of age and a wider range of reimbursements for women over this age than before – these are the assumptions of the draft amendment to the act by Third Way politicians. The proposal to change the regulations notes that after the radicalization of abortion law in 2020, “women’s situation has become even worse, their sense of security has decreased.”

The intention to submit a draft amendment to the Act on health care services financed from public funds and the Act on the reimbursement of medicines, foodstuffs intended for particular nutritional uses and medical devices was announced at a press conference in the Sejm by MP Ewa Szymanowska (Poland 2050-TD), who is the representative of the project’s applicants.

Third Way: after the abortion law was changed, the situation of women worsened

In the justification for the project, it was noted that the health needs of adult and minor women have remained unmet for many years. “Since the radicalization of abortion law, the situation of women has even worsened, their sense of security has decreased. No adequate actions have been taken to ensure women’s good health, and no discussion on the need for changes in the area of women’s health in the public health sector has been abandoned,” we read.

Draft bill on abortion. Third Way Proposal

On Friday, at a press conference in the Sejm, Third Way politicians (PSL and Polska2050) informed o submitting a bill on abortion to the Sejm. It reverses – as the politicians of this coalition said – “the shameful judgment of the Constitutional Tribunal from 2020, after which Poles took to the streets and said enough is enough.” TD politicians also announced a proposal for a referendum on this matter.

The anti-abortion regulations in force in Poland since 1993 were changed after the judgment of the Constitutional Tribunal in October 2020. Previously, the Act on Family Planning, Protection of the Human Fetus and Conditions of Permissibility of Termination of Pregnancy, known as the Abortion Compromise, allowed abortion also in the event of severe and irreversible impairment of the fetus or an incurable disease that threatened its life. The Constitutional Tribunal found this ground for termination of pregnancy to be unconstitutional, which caused a wave of protests throughout the country. This provision expired with the publication of the Constitutional Tribunal’s ruling in January 2021.

The discussion on abortion law and free contraception is taking place at the same time as The Sejm also passed an amendment to the act on emergency contraception, i.e. the so-called “morning after” pill.. According to the regulations contained therein, it is to be available without a prescription for people over 15 years of age.
