President Andrzej Duda referred to the Constitutional Tribunal without his signature the amendment to the law on the Supreme Court, the adoption of which was supposed to enable Poland to receive EU funds from the National Reconstruction Plan. – We said: you have the green light, don’t screw it up. And yet you are spartolistic – assessed the operation of the ruling camp, Deputy Speaker of the Sejm Piotr Zgorzelski (PSL) in “Kawa na Ława”. The head of the presidential office, Paweł Szrot, commented that Andrzej Duda “is not in the habit of making decisions just because everyone expects him to.”

Andrzej Duda announced on Friday that refers the amendment to the law on the Supreme Court to the Constitutional Tribunal in preventive control mode. This means that the law will not be in force until the Constitutional Tribunal has ruled on its compliance with the Constitution. The president called on the judges to deal with the case immediately.

In “Kawa na Ława” on TVN24, politicians referred to this on Sunday: MP Joanna Kluzik-Rostkowska from the Civic Coalition, Deputy Speaker of the Sejm on behalf of the Left Vladimir CzarzastyArtur Dziambor, MP from the Konfederacja circle, Jarosław Sellin, Deputy Minister of Culture from Law and Justice, Piotr Zgorzelski, Deputy Speaker of the Sejm from the Polish People’s Party, and Paweł Szrot from the Chancellery of the President.

Kluzik-Rostkowska: this money moves away from us even further

– If the Sejm adopted the amendments of the opposition, which could make this law constitutional, the president would not have this problem – assessed Joanna Kluzik-Rostkowska. She noted that “this whole story, this endless telenovela, began many years ago, when PiS began to rule, with the devastation of the judiciary.” “Now we are at the next stage,” she added.

– If PiS did not devastate the Polish judiciary, we would not have this type of problem at all. We have them at the request of PiS – assessed the KO MP.

In her opinion, “the presidential decision means that this money is moving away from us even more, that it will simply not be there.” – The whole story with the devastation of the Polish judiciary was absolutely unnecessary and these are the consequences – she said.

– What interest do Poles have in not getting money from the European Union? she asked.

Czarzasty: PiS is not able to arrange this

Włodzimierz Czarzasty said that he was not satisfied, “because there will be no money at the moment and the whole procedure will be delayed”. – It is no longer absolutely dependent on the European Commission. PiS, Mr. President, and the PiS government have made it so that the condition for the receipt of this money is the victory of the opposition in the elections in October. As long as the opposition does not win the elections, PiS is unable to reach an agreement and PiS is unable to arrange it, he assessed.

– I would take him [prezydenta Dudy – red.] arguments that he acts in accordance with the constitution, only because of him, among other things, this situation happened. If he hadn’t broken the constitution for seven years, if he hadn’t signed hopeless laws and appointed people outside the law to various positions, this whole situation wouldn’t have happened – he noted.

– PiS played so much, got so tangled that the money simply does not exist. What do I care if the president, or the prime minister, or Mr. Ziobro, or Mr. Kaczyński do anything in this matter? They broke the system because of their own incompetence – he said.

In his opinion, Andrzej Duda “ran away from responsibility like the last coward”.

Sellin: We wanted to settle this matter on the basis of a political compromise

Jarosław Sellin assessed that “if the opposition’s amendments were accepted, the president would have to veto this law”.

“I am disappointed because this dispute is not legal. This is a purely political dispute caused by the fact that the opposition has been working hard for the last few years to persuade its friends in the European Commission, and most of them, to use this instrument in the fight against the Polish right-wing government, he said.

– This compromise, which we negotiated in Brussels, was a political compromise. Of course, it has a legal form and you have to take a stance on this legal form, but we wanted to settle this matter on the basis of a political compromise – he argued.

He admitted that “the president had the right to make such a decision, because he is the guardian of the constitution and is even obliged to analyze the document whether it is consistent with the constitution or not.”

Zgorzelski: the message from the president went in two directions

Piotr Zgorzelski noted that “the message sent by Mr. President went in two directions”. – The first is to the European Commission, which was informed that Poland is not able to submit an application for National Reconstruction PlanAnd that’s very bad news, he said.

– The second was sent inside, to craftsmen, farmers, entrepreneurs waiting for this money, everyone for whom this money was a pro-development drip – he added.

– We all learned that this authority is already so twisted internally that it is not able to develop a simple bill – said the Deputy Speaker of the Sejm.

Addressing the representatives of the ruling camp, he continued that “in the triangle prime minister, president and minister of justice, you are not able to work out a simple bill in which the opposition tried not to disturb you by abstaining.” – We said: you have the green light, don’t screw it up. And yet you screwed up, you couldn’t complete a simple project, that is, even communicate with the president – he said.

Dziambor: These problems have hit Law and Justice in the face

Artur Dziambor, an MP from the Wolnościowcy group, which is part of the Confederation’s parliamentary circle, assessed that “it would be better if the president vetoed it.”

– There will be a very interesting skirmish inside the Constitutional Tribunal. Ziobrists with ducklings will be fighting over what to do with it. Ultimately, the unconstitutionality of some provisions makes it obvious that Law and Justice surrendered to the dictates of the European Union – he said.

– The fate of this act will someday be discussed by political scientists and doctorates will be made on it, because it all started almost three years ago, when the prime minister agreed to link the so-called rule of law with payments of money. It was at that moment that it was known that there would be problems. These problems hit Law and Justice in the face, he added.

Szrot: This law raises serious constitutional questions

– The president always has four options. Sovereignly and independently chooses one of them. This time, he decided to refer the bill to the Constitutional Tribunal without a signature, said the head of the presidential cabinet, Paweł Szrot.

He explained that “this bill raises serious constitutional questions.” – This is not only about the president, who also analyzed this act on his own, but I would like to remind you of the opinion of the Supreme Administrative Court, the Supreme Court – he said.

– The President appealed to the Constitutional Tribunal to quickly deal with this matter, to consider his application quickly, and in this sense he wants a very quick resolution – he added.

Szrot argued that “the president is not in the habit of making decisions just because everyone expects it from him or expects it from him.” – The President assessed the constitutional doubts so seriously that he decided to refer this bill to the Constitutional Tribunal before signing it – he explained.
