Gdańsk. Nearly PLN 14 million in compensation for a plot of land in Westerplatte

The Pomeranian Voivode obliged the Museum of the Second World War in Gdańsk to pay the city of Gdańsk nearly PLN 14 million for the plot in Westerplatte. This is a consequence of the judgment of the Provincial Administrative Court.

“Based on the appraisal report and the collected evidence, the Pomeranian Voivode Beata Rutkiewicz issued a decision to pay compensation in the amount of PLN 13,951,797.30 to the city of Gdańsk for plot no. 68 used for the implementation of the Museum investment. Westerplatte and the War of 1939 – Branch of the Museum of the Second World War. At the same time, it obliged the Museum of the Second World War in Gdańsk to pay the said compensation,” the Pomeranian Voivodeship Office in Gdańsk announced on its social media profile on Friday.

The case dragged on for years

The dispute regarding the valuation of land taken over by the State Treasury from the Gdańsk Commune lasted several years. According to the commune, these areas are worth nearly PLN 19 million. The Museum of the Second World War ordered its own survey, which valued the land at PLN 3.7 million, and later the survey was revised to PLN 7.6 million.

Because the parties did not reach an agreement, the case was referred to the Pomeranian Voivode and at the beginning of January 2021, administrative proceedings were initiated to determine compensation for the property. An appraisal commissioned by the then voivode, Dariusz Drelich, estimated the value of the land in Westerplatte at PLN 13.1 million. However, for two years the voivode did not issue a decision on determining the amount of compensation for Gdańsk, and finally, in the spring of 2023, he asked the city to consider waiving the compensation in full. In January this year The Provincial Administrative Court ruled that the former Pomeranian Voivode, Dariusz Drelich, committed a gross violation of the law by not determining the amount of compensation. The Provincial Administrative Court obliged the new Pomeranian Voivode to: resolving the matter within 90 days from the date of receipt of a copy of the final judgment together with the case files. He also ordered the voivodeship office to pay the city of Gdańsk monetary compensation in the amount of PLN 10,000. zloty. for the ineffective handling of this case by the previous voivode.
