The District Prosecutor’s Office in Gdańsk submitted a request to the Speaker of the Senate for consent to bring Senator Krzysztof Brejza criminally liable – Grażyna Wawryniuk, spokeswoman for the District Prosecutor’s Office in Gdańsk, said in a press release. The case is related to an investigation into irregularities at the town hall in Inowrocław.

The prosecutor charged Ryszard Bthat in the period from January 2015 to October 2017, in order to obtain financial and personal benefits, he exceeded his powers and failed to fulfill the duties of the Mayor of Inowrocław. Then Ryszard Brejza also referred to that announcement in a statement. “The charges against me were based on slander, with a high degree of probability, of the people with the allegations and those associated with PiS and Solidarna Polska,” he argued.

“I cannot understand how it is possible that the accusation concerns the publication of an alleged article aimed at a political opponent of the mayor of Inowrocław. I am being charged in a situation where the case was already investigated in 2016 by the prosecutor’s office and the Regional Chamber of Audit, and no no violation of the law was found,” he added.

In Wednesday’s announcement, Wawryniuk said that “further analysis of the evidence showed that the originator of the idea to establish the above-mentioned department within the structure of the town hall was Krzysztof B. and it was he who actually managed the ‘works’ of this unit.” “First, he appointed the department’s staff, and then supervised the practice of, among other things, creating fictitious user accounts on social networking sites by city hall employees and publishing anonymous critical comments through them.”

“As evidence shows, the ‘work’ of the department coordinated by Krzysztof B. also consisted in participating in online plebiscites and competitions and commenting widely on the Internet in a way that was favorable to the B family.” – added.

The statement also stated that “the evidence collected in the case indicates that Krzysztof B. cooperated with his father in using the local government apparatus to achieve his own goals.” According to the prosecutor’s office, both “acted to the detriment of the public interest of the City of Inowrocław.”

“In the application to waive his immunity, the prosecutor classified Krzysztof B.’s actions as pursuant to Article 231 §1 and 2 in connection with Article 21 § 2 of the Penal Code, i.e. as an abuse of powers or failure to fulfill duties,” the prosecutor’s office said.

§ 1. A public official who, exceeding his or her powers or failing to fulfill his or her duties, acts to the detriment of the public or private interest shall be subject to the penalty of imprisonment for up to 3 years. § 2. If the perpetrator commits the act specified in § 1 in order to obtain a financial gain or personal, is punishable by imprisonment from one to 10 years.

Investigation into the so-called invoice scandal

We also read on the prosecutor’s office website that “in another thread about irregularities in the Inowrocław town hall, the District Prosecutor’s Office in Gdańsk had previously sent an indictment to the District Court in Inowrocław, covering 17 people.”

“It concerns the extortion of several hundred thousand zlotys from public funds on the basis of false and forged documents, including invoices issued to the Inowrocław City Hall and the Ziemowit Cultural and Sports Center in Kruszwica by entrepreneurs cooperating with officials. These invoices were used to obtain payments from the budget of the units. money for services that did not take place or were not provided to the office,” it was written.

“The issue of Ryszard B. is still ongoing at the stage of preparatory proceedings,” the spokeswoman noted.

In this case, Ryszard Brejza – as the president of Inowrocław – is the injured party. But the Gdańsk prosecutor’s office also charged him with exceeding his powers and failing to fulfill his duties, although in a thread excluded from separate proceedings. As part of the invoice investigation – as we reported on tvn24.pl in January this year – witnesses were also questioned about Krzysztof Brejza.

The case of inflated invoices

Since 2015, the anti-corruption service and the prosecutor’s office have been investigating the case of siphoning several hundred thousand zlotys from the city treasury using false invoices. The main suspect in this case is an official of the Inowrocław municipality, Agnieszka Ch. As the head of the culture department, she accepted all invoices questioned by the CBA, most often of inflated value or for services not provided.

Ryszard Brejza filed a report to the prosecutor’s office after an inspection carried out in the department headed by Agnieszka Ch.

Information about Krzysztof Brejza’s surveillance using Pegasus

So far, cases of Pegasus surveillance in Poland have been reported independently by the Citizen Lab and Amnesty International. The list included, among others, KO senator Krzysztof Brejza. According to Citizen Lab he was surveilled 33 times before the 2019 parliamentary elections, when he was the head of the KO election staff.

In January 2022, Sen sued Jarosław Kaczyński for not only confirming in a press interview that the Polish services have the Pegasus surveillance system, but also suggesting that Brejza is under serious suspicion. However, he did not specify what suspicions he was talking about. Since no proceedings were pending against Brejza, the opposition senator considered this statement to be slander.

A few hours after Krzysztof Brejza submitted the notification, to the city hall building in Inowrocław Two CBA officers arrived and handed the father of KO senator Ryszard Brejza an envelope with a letter inside – a summons to the prosecutor’s office.

Central Anticorruption Bureau used the Pegasus spyware against Krzysztof Brejza, which is confirmed by documents obtained by “Superwizjer” reporters Łukasz Ruciński and Maciej Duda. They obtained important witnesses and never-published documents that show the behind-the-scenes of this surveillance. The documents confirm that the CBA downloaded over 80,000 messages, e-mails, calendars, contacts, locations and saved passwords from the politician’s smartphone and his cloud.
