Gliwice. The councilor was charged with child pornography

Among the candidates for the City Council in Gliwice (Silesian Voivodeship) is a councilor of the group that was previously in power there, who was charged by the Krakow prosecutor's office with possession of pornographic content involving a minor. The man is in custody.

Pursuant to the Electoral Code, candidates with allegations do not lose their right to be elected until they are convicted in a final judgment.

Representatives of the electoral committee from which the current councilor is running expressed their complete surprise and shock at the situation and expected an immediate clarification of the matter.

As the spokesman for the District Prosecutor's Office in Kraków, Prosecutor Janusz Kowalski, said on Wednesday, the District Prosecutor's Office in Kraków – Śródmieście Wschód is supervising the investigation conducted by the Management Board in Kraków of the Central Bureau for Combating Cybercrime in the case of a crime under Art. 202 par. 4a of the Penal Code.

§ 4a. Whoever imports, stores or possesses pornographic content involving a minor under 15 years of age shall be subject to the penalty of imprisonment from 3 months to 5 years.

“In this case, charges were presented to Michał J., with whom procedural activities were carried out. At the request of the prosecutor, the District Court for Kraków – Śródmieście, 2nd Criminal Department, in a decision of March 17, 2024 (…) applied a preventive measure against Michał J. in the form of a temporary arrest for a period of three months, i.e. until June 13, 2024,” said prosecutor Kowalski.

The spokesman for the Krakow prosecutor's office noted that due to the nature of the case and its further progress, investigators cannot provide more detailed information.

“Shocking” content of the allegations

“The detention of one of the candidates for a councilor is a complete surprise to us,” said the electoral committee from which Michał J is seeking re-election. “The content of the allegations we learn about from a press inquiry and the date of their publication a few days before the elections are of concern to us. shocking. We expect that the relevant services will immediately clarify this matter,” wrote representatives of KWW Koalicja dla Gliwice Z. Frankiewicza.

On Wednesday afternoon, Michał J.'s name appeared in the register of candidates for the Gliwice City Council. The councilor is running in the local district no. 2 from the third place on his committee's list.

Pursuant to Art. 11 pairs 2 point 1 of the Electoral Code, only a person who has been sentenced by a final court judgment to imprisonment for an intentional crime, prosecuted by public indictment or an intentional fiscal crime, has no right to be elected (cannot stand as a candidate), until the person is erased from the records of the National Criminal Register.
